Verify your degree meets specialty occupation requirements
USCIS requires your degree field to directly relate to commercial project management. A construction management, civil engineering, or architecture degree strengthens your petition. A general business degree alone can trigger an RFE, so gather transcripts showing relevant coursework before applying.
Target employers with active LCA filing history
Search Migrate Mate to filter Commercial Project Manager roles by employers who have filed LCAs for this exact title. Employers with repeat filings have established internal H-1B workflows, which reduces delays and guesswork during the petition process.
Confirm the prevailing wage tier before negotiating
Use the OFLC Wage Search to look up the prevailing wage for your target metro before discussing compensation. Your offered salary must meet at least the Level I wage for your location and job duties, and mismatches are a common reason LCA certifications stall.
Get your PMP credential before the H-1B transfer window
A Project Management Professional certification tied to commercial construction or infrastructure projects directly supports specialty occupation claims. Employers are more willing to sponsor candidates whose credentials align with the SOC code listed on the LCA, reducing back-and-forth with USCIS.
Negotiate project scope into your offer letter
USCIS scrutinizes vague job descriptions for project management roles. Ask your employer to include specific project types, contract values, and cross-functional team structures in your offer letter. Detailed scope language reduces the chance of a specialty occupation RFE during adjudication.
File during cap season if you're outside the exempt track
Cap-exempt employers in higher education or nonprofits can file H-1B petitions year-round, but most commercial construction and real estate firms are cap-subject. Make sure your employer registers during the USCIS H-1B registration window each March to avoid missing the filing cycle entirely.

Find Commercial Project Manager JobsCommercial Project Manager H-1B Visa: Frequently Asked Questions
Does a Commercial Project Manager role qualify as an H-1B specialty occupation?
Yes, provided the position requires a bachelor's degree or higher in a specific related field such as construction management, civil engineering, or architecture. USCIS evaluates each petition individually, so the job description must clearly tie the duties to that degree requirement. Roles that accept any bachelor's degree regardless of field are more likely to receive an RFE.
Which industries sponsor H-1B visas for Commercial Project Manager positions most often?
General contractors, real estate developers, engineering and design firms, and large infrastructure companies file LCAs for this title regularly. Government contractors with federal construction portfolios also sponsor frequently because H-1B rules apply to private employers regardless of project funding source. You can browse active sponsoring employers by title on Migrate Mate.
How does the H-1B prevailing wage requirement affect Commercial Project Manager roles?
DOL requires your employer to certify on the LCA that your offered wage meets or exceeds the prevailing wage for the Commercial Project Manager title in your work location. Wages vary significantly by metro, project type, and experience level. Use the OFLC Wage Search to look up the applicable wage tier for your target city before your offer is finalized.
Can I transfer my H-1B to a new commercial project management employer mid-project?
Yes. Under AC21 portability, you can transfer your H-1B to a new employer in the same or a similar occupational classification once your petition has been pending for 180 days or more. For Commercial Project Managers, the new role must fall under a comparable SOC code. Your new employer files an H-1B transfer petition and you can begin work once they receive a receipt notice.
What documents does an employer typically need to sponsor an H-1B for this role?
Your employer needs a certified LCA from DOL, your academic credentials and transcripts showing a qualifying degree, a detailed job description tying duties to that degree field, and proof of their ability to pay the prevailing wage. For commercial roles with variable project assignments, employers often include a master project list or client contracts to demonstrate that specialty occupation duties are ongoing rather than incidental.
