H-1B Visa Compliance Investigator Jobs
Compliance Investigator roles qualify for H-1B visa sponsorship as specialty occupations requiring a bachelor's degree in law, criminal justice, business, or a related field. Employers in financial services, healthcare, and government contracting file LCAs with the DOL before sponsoring, and many run active H-1B programs year-round outside the cap through cap-exempt institutions.

Verify your degree field supports the petition
USCIS scrutinizes whether your degree directly relates to compliance investigation. A degree in law, accounting, criminal justice, or public policy strengthens the specialty occupation argument. A general business degree may require supporting documentation showing curricular alignment.
Target cap-exempt employers for faster sponsorship
Hospitals, universities, and nonprofit research organizations are cap-exempt, meaning they can file your H-1B petition any time of year without lottery risk. Compliance investigator roles at these institutions often go unfilled because applicants assume all H-1B hiring is lottery-dependent.
Search LCA filings by occupation code to find active sponsors
Use Migrate Mate to filter employers who have filed LCAs under Compliance Officer and similar SOC codes. This shows you which organizations are actively sponsoring roles in your field, not just companies with general H-1B history.
Check the prevailing wage before negotiating your offer
Your employer must pay at least the DOL prevailing wage for your role and location. Run your job title and ZIP code through the OFLC Wage Search before accepting an offer so you know the wage floor your LCA must certify.
Ask HR whether the role uses E-Verify before accepting
Federal contractors and many regulated industries require E-Verify enrollment, which affects your onboarding timeline. If your employer isn't enrolled, your work authorization verification may take longer and could delay your start date after the H-1B is approved.
Document your investigation caseload for potential RFEs
USCIS sometimes issues Requests for Evidence questioning whether compliance investigator duties are sufficiently specialized. Gather performance reviews, case summaries, or written descriptions of your investigative methodology before your employer files the I-129 petition.
H-1B Visa Compliance Investigator: Frequently Asked Questions
Does a Compliance Investigator role qualify as a specialty occupation for H-1B purposes?
Yes, in most cases. USCIS evaluates whether the position normally requires at least a bachelor's degree in a specific field. Compliance Investigator roles tied to financial regulation, healthcare auditing, or federal contracting typically satisfy this standard. Roles where any degree is accepted regardless of field are more likely to receive an RFE, so the job description should specify a directly related discipline.
Which industries sponsor H-1B visas most often for Compliance Investigator positions?
Financial services firms, healthcare systems, pharmaceutical companies, and federal government contractors file LCAs for compliance roles regularly. These industries operate under strict regulatory frameworks that create sustained demand for investigators. You can browse active H-1B sponsoring employers in these sectors by searching Compliance Investigator roles on Migrate Mate, which surfaces employers with verified LCA filing history.
Can a Compliance Investigator be sponsored outside the H-1B lottery?
Yes, if you work for a cap-exempt employer. Universities, nonprofit research organizations, and government-affiliated institutions can file H-1B petitions at any time without entering the annual lottery. Some compliance roles at teaching hospitals or university compliance offices fall into this category. If you're currently on OPT, your cap-gap protection covers you until October 1 if your lottery petition is selected.
What does the DOL prevailing wage requirement mean for a Compliance Investigator offer?
Before your employer files the LCA, DOL must certify that your offered wage meets or exceeds the prevailing wage for your job title and geographic location. This is based on four wage levels tied to experience and complexity. You can verify the applicable wage level for your role using the OFLC Wage Search, which lets you look up rates by occupation and metropolitan area.
How does changing employers affect an H-1B holder in a Compliance Investigator role?
H-1B portability under AC21 lets you change employers after your petition has been pending for 180 days or more, as long as the new role is in the same or a similar occupational classification. For compliance investigators, moving between regulated industries generally satisfies this requirement, but your new employer must file an H-1B transfer petition before or shortly after you start.
