Get Access To All JobsTips for Finding H-1B Visa Sponsorship in Probation Officer
Verify your degree meets specialty occupation
USCIS requires a bachelor's degree in a directly related field, typically criminal justice, social work, psychology, or counseling. A degree in an unrelated discipline weakens the specialty occupation argument and invites an RFE before USCIS approves the petition.
Target private corrections contractors over agencies
State and county probation agencies are government employers and generally cannot sponsor H-1B visas due to public employer restrictions. Private corrections management companies and nonprofit supervision organizations are your realistic sponsorship pool.
Search LCA filings on Migrate Mate
Pull up Probation Officer LCA filing history by employer on Migrate Mate before applying. You'll see which private organizations have actually certified filings for this SOC code, so you're targeting confirmed sponsors rather than guessing.
Confirm prevailing wage tier before negotiating
Run the Probation Officer SOC code through the OFLC Wage Search for the specific county where you'd work. Wage levels vary significantly by jurisdiction, and your offer must meet the certified LCA wage or USCIS will deny the petition.
Ask about cap-exempt status during interviews
Some nonprofit offender rehabilitation organizations qualify as cap-exempt H-1B employers, which means they can file outside the annual lottery. Confirming this during the offer stage tells you whether you need to wait for a registration cycle or can file immediately.
Get state licensure documentation ready before filing
Many states require probation officers to hold a specific certification or pass a background check before starting work. Gather those credentials in advance because the employer's attorney will need them when preparing the I-129 specialty occupation support letter.

Find Probation Officer JobsProbation Officer H-1B Visa: Frequently Asked Questions
Do government probation departments sponsor H-1B visas?
Most state and county probation agencies cannot sponsor H-1B visas because government employers are generally excluded from H-1B sponsorship. Your best path is through private corrections management companies, nonprofit reentry organizations, and community supervision contractors that operate under government contracts but file as private employers with USCIS.
Does a Probation Officer role qualify as an H-1B specialty occupation?
Yes, provided the employer can document that the position normally requires at least a bachelor's degree in a specific field such as criminal justice, social work, psychology, or counseling. Roles structured as general public safety positions without a degree requirement in a specific discipline are harder to defend and more likely to receive an RFE from USCIS.
How do I find employers who have sponsored H-1B visas for Probation Officers?
Search by SOC code on Migrate Mate to see which employers have certified Labor Condition Applications for Probation Officer roles. DOL LCA disclosure data is the most reliable indicator of actual sponsorship history, since it reflects filings an employer has already committed to rather than job postings that may never lead to a petition.
Does a state probation officer certification affect my H-1B petition?
State licensure requirements can strengthen the specialty occupation argument by demonstrating that the role demands specific professional credentials beyond a general degree. Include documentation of any required state certification in your employer's I-129 support package, since USCIS adjudicators look at licensing requirements as evidence that the position meets specialty occupation standards.
What happens to my H-1B status if my employer loses a government supervision contract?
If your employer loses the contract funding your position, your H-1B employment authorization ends with that job. You have a 60-day grace period under USCIS rules to find a new H-1B sponsor, change to another valid status, or depart the country. Transferring your H-1B to a new qualifying employer through a portability filing preserves your status during the transition.
