Verify your degree meets specialty occupation standards
USCIS scrutinizes Legal Consultant petitions closely when your degree is in a field adjacent to law rather than law itself. A J.D., LL.B., or LL.M. in a directly related specialty strengthens your petition and reduces RFE risk.
Target cap-exempt employers first
Universities, nonprofits affiliated with universities, and certain government research institutions are cap-exempt. Legal Consultant roles at these organizations don't enter the lottery, so you can start any time of year without waiting for April registration.
Search LCA filing history on Migrate Mate
Filter by Legal Consultant roles to see which employers have certified LCAs with the DOL for this exact title. That filing history confirms an employer already understands the H-1B process and has sponsored comparable positions before.
Check prevailing wage before negotiating your offer
Your employer must pay at least the DOL prevailing wage for Legal Consultant in your work location. Run the OFLC Wage Search using SOC code 23-1011 before accepting an offer to confirm your salary meets Level I through IV wage requirements.
Clarify your job duties match the O*NET profile
USCIS compares petition language against the O*NET occupation profile for Legal Consultants. If your role blends paralegal duties with consulting work, work with your employer to frame duties in terms that align with the specialty occupation definition to avoid a denial.
Understand the 60-day grace period when changing roles
If your current H-1B employment ends, you have 60 days to secure a new sponsoring employer and file a transfer petition. Filing during this window maintains your status, but the new employer's LCA must be certified before the I-129 is submitted to USCIS.

Find Legal Consultant JobsLegal Consultant H-1B Visa: Frequently Asked Questions
Does a Legal Consultant role qualify as a specialty occupation for H-1B purposes?
Yes, provided the position genuinely requires at least a bachelor's degree in a specific field such as law, international business, or regulatory affairs. Generic consulting roles that accept any degree often face USCIS RFEs. Your employer's job description must tie the required degree directly to the duties performed, not just list a degree as a preference.
Which industries sponsor H-1B visas most often for Legal Consultant positions?
Corporate legal departments at multinational companies, financial services firms with compliance needs, and management consulting firms that serve regulated industries file the most LCAs for Legal Consultant roles. Universities and nonprofits also sponsor this title and have the added advantage of cap-exempt status. You can browse current openings at employers with verified H-1B filing history on Migrate Mate.
Can a foreign law degree support an H-1B petition for a Legal Consultant role?
A foreign law degree can qualify, but USCIS requires an evaluation by a recognized credential assessment organization to confirm it is equivalent to a U.S. bachelor's degree or higher in law or a related field. A three-year LL.B. from many countries may not automatically satisfy the equivalency standard without supplemental work experience or a credentials evaluation.
What happens to my H-1B status if my Legal Consultant contract ends before the petition expires?
You have a 60-day grace period from the date your employment ends to either transfer your H-1B to a new sponsoring employer, change to another visa status, or depart the U.S. During this window, USCIS considers you in a period of authorized stay. Filing an H-1B transfer before the 60 days expire lets you start the new role once the transfer petition is received by USCIS.
Do Legal Consultant employers need to go through PERM labor certification before sponsoring an H-1B?
No. PERM labor certification is required for permanent residence sponsorship, not for the H-1B, which is a temporary nonimmigrant visa. Your employer files a Labor Condition Application with the DOL to certify wages and working conditions, but there is no recruitment or labor market test requirement for the H-1B petition itself.
