Verify your degree meets specialty occupation
USCIS requires a direct relationship between your degree field and Construction Manager duties. A degree in construction management, civil engineering, or architecture satisfies this. A general business degree often triggers an RFE, so gather course transcripts that show technical coursework before applying.
Target contractors enrolled in E-Verify
Federal construction contractors and subcontractors are legally required to use E-Verify, which signals established HR infrastructure for work-authorization compliance. These firms are more likely to have H-1B filing experience than smaller regional builders who rarely hire internationally.
Check prevailing wage before accepting an offer
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your job zone and metro area. Run the OFLC Wage Search using SOC code 11-9021 before negotiating, so you know the floor and can flag any offer that would fail DOL certification.
Use Migrate Mate to find verified sponsoring employers
Filter Construction Manager roles by employers with active LCA filing history on Migrate Mate. This surfaces companies that have already navigated DOL certification for this occupation, reducing the risk of approaching employers unfamiliar with the H-1B process for site-based roles.
Clarify multi-site work with your employer early
Construction Managers often rotate across project sites, which complicates the LCA's worksite address requirement. Your employer must file an amended LCA or rely on the short-term placement rule for sites not listed. Raise this before your I-129 is filed, not after placement starts.
Request premium processing if your start date is tight
USCIS offers 15-business-day adjudication through premium processing for an additional fee. Construction projects run on fixed timelines, so if your employer's project start date is within six months of your offer, premium processing avoids delays that could push your site mobilization past the H-1B approval.
H-1B Visa Construction Manager: Frequently Asked Questions
Does a Construction Manager role qualify as an H-1B specialty occupation?
Yes, if the position normally requires at least a bachelor's degree in a directly related field such as construction management, civil engineering, or architecture. USCIS evaluates the job description, not just the title. Roles that accept any bachelor's degree as a substitute, regardless of field, frequently receive RFEs challenging specialty occupation status, so the job posting's degree requirement wording matters significantly.
Which employers sponsor H-1B visas for Construction Manager positions?
Large general contractors, engineering and design-build firms, and real estate development companies with dedicated HR departments are the most consistent H-1B sponsors for this role. Federal contractors subject to E-Verify mandates also tend to have established immigration processes. Migrate Mate lets you filter Construction Manager listings by verified LCA filing history so you can focus on employers already familiar with the process.
How does working across multiple construction sites affect my H-1B petition?
Each primary worksite must be listed on the certified LCA, and your employer must post LCA notices at each location. For short-term assignments at unlisted sites, DOL allows placement for up to 60 workdays per year if your primary worksite is elsewhere. Assignments exceeding that threshold require an amended LCA before work begins at the new location, which affects project scheduling timelines.
Can I transfer my H-1B to a new construction employer mid-project?
Yes, H-1B portability under AC21 lets you start working for a new employer as soon as the transfer petition is filed with USCIS, provided your original H-1B has been approved for at least 180 days. Your new employer must file a fresh LCA reflecting the new worksite and wage level. You don't need to wait for USCIS to approve the transfer petition before beginning work.
What O*NET classification applies to Construction Manager H-1B petitions?
USCIS and DOL reference the O*NET profile for Construction Managers under SOC code 11-9021. This classification places the occupation in Job Zone 4, which corresponds to substantial preparation and typically a four-year degree. Your employer's attorney will use this O*NET data alongside the OFLC Wage Search to establish the prevailing wage level required for LCA certification.
