H-1B Visa District Attorney Jobs
District Attorney roles sit at the intersection of law, public service, and government employment, a combination that creates real complexity for H-1B sponsorship. Most DA offices are government entities, and government employers face specific H-1B filing constraints that private law firms don't. Understanding which offices can sponsor before you apply changes everything.

Check whether the DA office is cap-exempt
Some DA offices affiliated with nonprofit legal organizations or government research institutions qualify as cap-exempt H-1B employers, letting them file outside the annual 85,000-cap lottery. Confirm the office's employer classification with USCIS before counting on cap-exempt status.
Look up prevailing wages before negotiating your offer
DA offices must pay H-1B holders at least the prevailing wage for the role and county. Run the OFLC Wage Search using SOC code 23-1011 to see the Level I through Level IV wage tiers for the specific location before your salary negotiation.
Find DA offices with H-1B LCA filing history on Migrate Mate
Search Migrate Mate to identify which district attorney offices have filed Labor Condition Applications for legal roles. LCA history confirms an office has actually sponsored H-1B workers before, not just that they're theoretically willing.
Get bar admission on record before the H-1B start date
Most DA offices require active state bar admission as a condition of employment. USCIS also expects the specialty occupation requirement to be met from day one of H-1B status, so pass the bar and get admitted before your petition's requested start date.
Ask HR about the I-129 filing timeline at the offer stage
Government employer HR teams often have longer internal approval chains than private firms. Confirm the DA office can file Form I-129 with enough lead time for standard processing or premium processing before your current status expires.

Find District Attorney JobsDistrict Attorney H-1B Visa: Frequently Asked Questions
Can a district attorney's office sponsor an H-1B visa?
Yes, but it depends on the office's structure. County and state DA offices are government entities and can file H-1B petitions, though many lack in-house immigration counsel and may be unfamiliar with the process. DA offices affiliated with nonprofit legal organizations may qualify as cap-exempt, allowing them to file outside the annual lottery. Confirm the office's H-1B filing history before accepting an offer.
Does a District Attorney role qualify as an H-1B specialty occupation?
A District Attorney position qualifies as a specialty occupation because it requires a Juris Doctor or equivalent foreign law degree as a minimum entry requirement for the role. USCIS evaluates specialty occupation status on the degree requirement, not the employer type. The O*NET occupation profile for lawyers confirms the standard educational requirement, which supports the specialty occupation classification in the H-1B petition.
How do I find district attorney offices that have sponsored H-1B visas before?
Check DOL Labor Condition Application disclosure data to see which DA offices have certified LCAs for attorney roles. Migrate Mate surfaces this filing history by employer and occupation, so you can filter for government legal employers with a track record of H-1B sponsorship rather than approaching offices cold and hoping they're willing to navigate the process.
What happens to my H-1B status if I leave a DA office for a different employer?
H-1B portability under AC21 lets you transfer your status to a new employer once your petition has been pending for 180 days or more, as long as the new role is in the same or a similar occupational classification. Moving between DA offices or to a private firm in a comparable legal role generally qualifies. Your new employer must file an H-1B transfer petition with USCIS before your current authorization expires.
Is bar admission required before an H-1B petition can be filed for a District Attorney role?
Most DA offices require active state bar admission as a condition of employment, and USCIS expects the specialty occupation requirements to be met from the H-1B start date. If you've passed the bar but aren't yet admitted, your employer can file the petition with a requested start date after your expected admission date. Filing before admission is confirmed creates risk if admission is delayed.
