H-1B Visa Faculty Position Jobs
Faculty positions at U.S. colleges and universities are among the most straightforward H-1B sponsorship paths: most universities are cap-exempt, meaning your petition bypasses the annual lottery entirely. Tenure-track and visiting roles regularly appear on H-1B sponsor lists, and multi-year contracts make renewal planning more predictable than in the private sector.

Verify cap-exempt status before applying
Most nonprofit universities and affiliated research institutions qualify as cap-exempt employers under INA Section 214(c)(1)(B). Confirm the institution's status with USCIS before investing time in an application cycle, since cap-exempt petitions can be filed any time of year.
Align your credentials to specialty occupation standards
USCIS evaluates faculty roles against the specialty occupation definition. Pull your O*NET profile for the specific discipline, then document how your graduate degree directly corresponds to the courses you'll teach or the research you'll lead.
Target departments with active LCA filing history
Use Migrate Mate to filter faculty openings by employers with verified H-1B Labor Condition Application filings in your academic discipline, so you're applying to departments that have already navigated the DOL certification process.
Request the LCA before your start date
Your employer must file the LCA with DOL and receive certification before USCIS adjudicates your I-129. Ask the international office for a projected LCA filing timeline during the offer stage, not after you've accepted.
Negotiate a start date that absorbs processing delays
Standard I-129 processing can run several months. If your appointment begins in August, an offer letter signed in March gives the institution time to file without relying on premium processing to rescue a late timeline.
Document the prevailing wage basis in your offer letter
The DOL requires the offered salary to meet the prevailing wage for your occupation and work site. Cross-check the institution's LCA wage level against your role using the OFLC Wage Search to confirm the offer satisfies the requirement before signing.

Find Faculty Position JobsFaculty Position H-1B Visa: Frequently Asked Questions
Do faculty positions typically require going through the H-1B lottery?
Most do not. Colleges, universities, and affiliated nonprofit research organizations are cap-exempt employers, meaning their H-1B petitions bypass the annual lottery and the 65,000 and 20,000 cap slots entirely. You can start a cap-exempt faculty role at any point in the year, so long as USCIS approves the I-129 before your employment begins.
What makes a faculty role qualify as a specialty occupation for H-1B purposes?
USCIS requires that the position normally requires at least a bachelor's degree in a specific academic discipline directly related to the duties. For most tenure-track and visiting instructor roles, the connection between the required advanced degree and the courses taught or research conducted satisfies this standard. Adjunct roles with loose degree requirements can sometimes draw scrutiny, so the job description should specify the required field precisely.
How long does H-1B sponsorship typically take for a university faculty hire?
After the offer is made, the department's international office files a Labor Condition Application with DOL, which normally certifies within seven business days. The I-129 petition is then filed with USCIS, with standard processing running three to six months. Institutions hiring for fall positions typically initiate the process in late winter or early spring to avoid relying on premium processing.
Can I change institutions while on an H-1B faculty appointment?
Yes. Under H-1B portability provisions, you can begin working for a new cap-exempt institution as soon as the new employer files an H-1B transfer petition with USCIS, without waiting for approval, provided your current H-1B is still valid and you're moving to a qualifying employer. The new institution handles the LCA and I-129 filing independently of your previous employer.
How do I find faculty positions at universities that sponsor H-1B visas?
Migrate Mate lets you search faculty openings filtered by employers with confirmed H-1B LCA filing history, so you can focus on institutions that have already completed DOL certification for academic roles in your discipline. This saves significant time compared to screening postings manually and then researching each university's sponsorship track record separately.
