Elementary school teachers can qualify for H-1B visa sponsorship when the role requires a bachelor's degree in education or a closely related field. Public school districts, charter networks, and private schools all file H-1B petitions, though state licensure requirements add a layer most other sponsored roles don't have.

Secure state licensure before your job search
Most districts won't file an H-1B petition until you hold a valid state teaching license. Start the credentialing process early, some states require a separate foreign credential evaluation that adds weeks to the timeline.
Target private and charter schools first
Public school districts are subject to collective bargaining agreements that sometimes restrict H-1B filings. Private and charter schools operate outside those constraints and have a stronger track record of sponsoring international teachers.
Search verified H-1B sponsors on Migrate Mate
Filter by elementary education roles on Migrate Mate to see which schools and districts have active H-1B LCA filing history with DOL. That filing history confirms genuine sponsorship intent before you invest time in an application.
Use OFLC Wage Search to benchmark your offer
Your employer must certify your salary meets the DOL prevailing wage for your role and county. Run your own check using OFLC Wage Search before accepting an offer so you can flag any shortfall during negotiations.
Clarify cap-exempt status with each employer
Some nonprofit and government-affiliated school employers qualify as cap-exempt, meaning they can file your H-1B outside the annual lottery. Ask the HR team directly whether they meet USCIS cap-exempt criteria before the April registration window.
Get your foreign degree evaluated for U.S. equivalency
USCIS requires your degree to be equivalent to a U.S. bachelor's in education. A credential evaluation from a NACES-member organization documents that equivalency and is required as part of the H-1B petition your employer files.
H-1B Visa Elementary School Teacher: Frequently Asked Questions
Does an elementary school teacher job qualify for H-1B sponsorship?
Yes, elementary school teaching qualifies as a specialty occupation when the employer requires a bachelor's degree in education or a subject-matter field. USCIS looks at whether the degree requirement is standard for the role. Districts and schools that mandate a specific degree, not just any bachelor's, have the strongest case for H-1B approval.
Do I need a state teaching license before my employer files the H-1B petition?
Most employers require you to hold or be eligible for a state teaching license before they'll begin the H-1B filing process. Some states allow employers to file with a license application in progress, but you'll typically need full licensure before your start date. Check your target state's department of education requirements early, since foreign-trained teachers often face additional evaluation steps.
Are public school districts less likely to sponsor H-1B teachers than private schools?
Public districts can and do sponsor H-1B teachers, but union contracts and district HR policies sometimes slow or limit filings. Charter schools and private schools generally have more flexibility. Many districts in states with documented teacher shortages, especially in bilingual education and special education, have active H-1B LCA filing histories. You can verify this on Migrate Mate before applying.
What happens to my H-1B status if the school district is cap-exempt?
Cap-exempt employers, including certain nonprofit and government-affiliated schools, can file your H-1B petition at any point during the year without waiting for the April lottery. Your petition is adjudicated directly by USCIS without competing for one of the 85,000 annual slots. This is a significant advantage for teachers at qualifying institutions and worth confirming with HR before you apply.
Can a school sponsor my H-1B if my degree is in a subject like mathematics rather than education?
Yes, if the school explicitly requires a degree in the subject you'll be teaching, a math or science degree can support the specialty occupation argument. USCIS evaluates whether the degree requirement is tied to the specific duties of the role. A math teacher position that requires a math degree, not just any bachelor's, satisfies the specialty occupation standard under that logic.
