Verify your credential alignment before applying
H-1B approval for this role depends on your degree field matching the job duties. A degree in rehabilitation counseling, clinical psychology, or social work typically satisfies specialty occupation. A general business or unrelated degree creates RFE risk even with years of relevant experience.
Target hospital systems over small nonprofits
Large hospital networks and federally qualified health centers file H-1B petitions far more consistently than small community nonprofits. Check DOL Labor Condition Application disclosure data to confirm an employer has active filings in behavioral health or counseling occupation codes before investing time in an application.
Search verified H-1B filers on Migrate Mate
Migrate Mate surfaces employers with confirmed LCA filing history for psychosocial and rehabilitation counselor roles, so you're not guessing which organizations will actually sponsor. Filter by occupation and location to target your search before outreach.
Confirm the prevailing wage tier your offer must meet
Your employer's LCA must certify your salary meets at least the Level I prevailing wage for your occupation and work location. Look up the applicable wage using the OFLC Wage Search before salary negotiations so you understand the floor DOL requires for your zip code.
Ask about petition timing relative to the lottery window
USCIS opens H-1B registration in March for an October 1 start date. If you receive a job offer after April, your earliest possible H-1B start is the following October. Clarify this timeline with hiring managers early so neither side is surprised by the gap.
Use O*NET to document your specialty occupation argument
If your employer's HR team is unfamiliar with H-1B specialty occupation requirements, the O*NET profile for this occupation lists the standard educational requirements and job zone classification. Share it when discussing the petition to help them work with their immigration counsel accurately.

Find Psychosocial Rehabilitation Counselor JobsPsychosocial Rehabilitation Counselor H-1B Visa: Frequently Asked Questions
Does a Psychosocial Rehabilitation Counselor role qualify as an H-1B specialty occupation?
Yes, if the position requires a bachelor's degree or higher in a specific related field such as rehabilitation counseling, clinical psychology, counseling psychology, or social work. The key is that the degree must be a standard minimum requirement for the role, not just preferred. If the job posting says 'any bachelor's degree accepted,' that weakens the specialty occupation argument and creates RFE risk.
Which types of employers sponsor H-1B visas for this role?
Hospital-based behavioral health departments, large integrated health systems, federally qualified health centers, and state-contracted mental health agencies are the most consistent H-1B filers for psychosocial rehabilitation counselor positions. Smaller community nonprofits sometimes sponsor but do so less reliably. Migrate Mate lets you filter by employers with verified LCA filing history in counseling and rehabilitation occupation codes so you can focus your search on organizations that have actually filed before.
What happens to my H-1B status if my position is reclassified or my duties change significantly?
A material change in job duties, work location, or employment terms can require your employer to file an amended H-1B petition with USCIS before the change takes effect. If your role shifts from direct client rehabilitation work to primarily administrative duties, the amended petition may need to re-argue specialty occupation. Talk to your employer's immigration counsel before accepting any significant role change.
Can I work at multiple clinical sites under one H-1B petition?
It depends on whether the additional sites are covered locations under your existing Labor Condition Application. If your employer adds a new worksite not listed on your LCA, they must post LCA notices at that location and may need to file an amended petition with USCIS. This is common in community mental health settings where counselors rotate between clinics, so confirm with HR before beginning work at any unlisted site.
How does the H-1B cap lottery affect my job search timeline for this role?
USCIS runs the H-1B registration lottery in March each year, with selected petitions filed by June and employment starting October 1. If you're selected, expect roughly a six-month gap between an offer and your actual start date. Some employers in this field are cap-exempt, including certain nonprofit research organizations and government entities affiliated with higher education, which means no lottery wait and faster filing timelines.
