Align your degree to the role
Your H-1B petition requires a direct connection between your degree field and the marketing role. A degree in communications, business, or marketing satisfies specialty occupation. A general arts degree without relevant coursework may draw an RFE from USCIS.
Verify LCA wage compliance before accepting
Before signing an offer, cross-check the stated salary against the DOL prevailing wage for your metro area using OFLC Wage Search. Underpaid LCAs get flagged during DOL review and delay your H-1B filing timeline.
Target employers with regional marketing hiring patterns
Use Migrate Mate to filter employers by H-1B LCA filings specifically for marketing roles in your target region. This surfaces companies that have sponsored this job title before, reducing the risk of an employer unfamiliar with the process.
Request premium processing if your start date is tight
Standard H-1B adjudication runs three to five months. If your OPT expires or your current status has a hard end date, ask your employer to file Form I-907 for premium processing, which guarantees a USCIS decision within 15 business days.
Document multi-market campaign scope in your petition
Regional marketing roles can face specialty occupation scrutiny because the title sounds generalist. Your employer's H-1B support letter should specify that the role requires degree-level analytical skills, market segmentation expertise, and cross-functional coordination across defined geographic territories.
Check O*NET before your employer files the LCA
The O*NET occupation profile for Marketing Specialists lists the education and knowledge requirements DOL uses to benchmark the role. Confirming your job duties map to that profile strengthens the specialty occupation argument and supports the prevailing wage tier selection.
H-1B Visa Regional Marketing Specialist: Frequently Asked Questions
Does a Regional Marketing Specialist role qualify as a specialty occupation for H-1B purposes?
Yes, provided the employer requires at least a bachelor's degree in marketing, communications, business, or a directly related field as a minimum qualification for the position. USCIS scrutinizes marketing roles more than technical ones, so the job description must specify degree-level requirements rather than listing a degree as preferred. Roles focused on campaign analytics, market research, or multi-region brand strategy typically satisfy the standard.
How do I find employers who have sponsored H-1B visas for marketing roles?
Search Migrate Mate to see which employers have filed H-1B Labor Condition Applications for Regional Marketing Specialist or similar titles. LCA filing history is public DOL data, so you can identify companies that have gone through the process before. Employers with prior marketing sponsorship are less likely to withdraw an offer due to process uncertainty.
What happens to my H-1B status if my employer transfers me to a different region?
A permanent reassignment to a new worksite outside the original LCA's metropolitan statistical area requires your employer to file an amended H-1B petition with USCIS and a new LCA for the new location. Short-term placements under 60 days have different rules. You should confirm the amended petition is filed before you begin working from the new location.
Can I work for multiple employers as a Regional Marketing Specialist on H-1B?
Yes, but only if each employer files a separate H-1B petition and you are authorized under each approved petition before starting work. A concurrent H-1B is not automatic. Each employer must independently certify prevailing wage compliance with DOL through its own LCA, and USCIS must approve each petition separately before you can perform work for that entity.
What documentation should I prepare before my employer files the H-1B petition?
Gather your academic transcripts and diplomas showing a degree in a directly related field, along with any credential evaluation if your degree is from outside the U.S. Your employer will need these to support the specialty occupation argument in the I-129 petition. A resume that maps your specific marketing responsibilities to degree-level skills also helps if USCIS issues an RFE.
