Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a Systems Engineer
Map your degree to SOC codes
Systems Engineer maps to SOC 17-2199, but some employers file under 15-1299 depending on the role's software emphasis. Check O*NET to confirm which code matches your actual duties before applying, since a mismatch can trigger an RFE.
Verify LCA filings before you apply
Use the OFLC Wage Search to confirm a company has filed LCAs for Systems Engineer roles in your target location. An employer willing to sponsor you still needs an active LCA certified before USCIS will accept the I-129 petition.
Search H-1B employers on Migrate Mate
Migrate Mate filters Systems Engineer jobs by verified H-1B sponsorship history, so you're only seeing employers who have filed for this role before. That saves time you'd otherwise spend vetting each company's sponsorship willingness separately.
Document system integration work specifically
Consulates and USCIS adjudicators sometimes question whether Systems Engineer is a true specialty occupation. A portfolio showing cross-functional architecture decisions, not just implementation tasks, strengthens the specialty occupation argument in your petition.
Ask about cap-exempt employer options
Universities, nonprofit research institutions, and government-affiliated labs are cap-exempt, meaning they can file your H-1B petition outside the April lottery window. Defense contractors with FFRDC affiliations sometimes qualify too, so ask explicitly during interviews.
Negotiate start dates around premium processing
Standard H-1B processing can run three to five months after USCIS receipt. If your employer won't use premium processing, your October 1 start is the earliest realistic date. Build that timeline into any offer negotiation so the employer isn't surprised.
H-1B Visa Systems Engineer: Frequently Asked Questions
Does a Systems Engineer role qualify as an H-1B specialty occupation?
Yes, provided the position requires at least a bachelor's degree in a directly related field such as systems engineering, electrical engineering, or computer science. Job postings that list a degree as preferred rather than required can create problems at adjudication. Your offer letter and the employer's internal job description should both state the degree requirement as mandatory before the I-129 is filed.
How do I find employers who have sponsored H-1B visas for Systems Engineers before?
Migrate Mate shows verified H-1B sponsorship history filtered by role, so you can see which employers have filed LCAs for Systems Engineer positions rather than guessing from company size or industry. You can also search the OFLC Wage Search directly to confirm recent LCA activity for a specific employer and work location before investing time in an application.
Can I transfer my H-1B to a new Systems Engineer job without losing my place in the queue?
Yes. Under H-1B portability rules, you can start working for a new employer as soon as the transfer petition is filed with USCIS, provided your current H-1B is in valid status and you're moving to a similar specialty occupation role. Systems Engineer to Systems Engineer transfers typically satisfy the same SOC code requirement, but your new employer still needs to file a fresh I-129 and a certified LCA.
What happens to my H-1B status if my Systems Engineer position is eliminated?
You have a 60-day grace period from your last day of employment to find a new sponsor, file a change of status, or depart the United States. During those 60 days you can't work, but you can interview and your prospective employer can file a new H-1B petition. If you're within six years of your initial H-1B period, a new employer can file immediately without waiting for the April lottery.
Does it matter whether my Systems Engineer role is hardware-focused versus software-focused for H-1B purposes?
It can. USCIS adjudicators look at whether the specific duties require a degree in a directly related field. A hardware-heavy systems integration role may map to SOC 17-2199 and require an engineering degree, while a software-defined systems role could map to SOC 15-1299. Your employer's attorney should match the LCA's SOC code to the actual duties in your offer letter to avoid an RFE on specialty occupation grounds.
