Verify your degree meets specialty occupation
USCIS requires your degree field to directly relate to tax work. A degree in accounting, finance, or taxation is strong. An unrelated bachelor's paired with a CPA or LLM in taxation can satisfy the requirement, but document the connection explicitly.
Target employers with active LCA filing history
Search the OFLC Wage Search for Labor Condition Applications filed under SOC code 11-3031. Employers who've filed LCAs for Tax Director or Tax Manager roles in the last two years are already set up to sponsor and know the process.
Use Migrate Mate to filter sponsoring employers
Migrate Mate shows verified H-1B filing history by employer and occupation, so you can focus your applications on companies that have sponsored Tax Director roles before, not just those that say they're open to sponsorship.
Clarify multinational assignment history upfront
If you've worked for a foreign affiliate of a U.S. employer, an L-1A transfer may be available alongside H-1B. Raising this with HR early can open a parallel path that bypasses the H-1B cap entirely.
Negotiate for premium processing in your offer
Standard H-1B adjudication can take several months. Request that your employer include USCIS premium processing in the offer letter. Most firms sponsoring senior tax hires will agree, and it reduces your start-date uncertainty significantly.
Prepare a specialty occupation support memo
For Tax Director roles, your employer's attorney may need to show that a specific degree is normally required, not just preferred. Pull the O*NET profile for tax managers and gather three to five job postings from comparable employers showing degree requirements.
H-1B Visa Tax Director: Frequently Asked Questions
Does a Tax Director role qualify as a specialty occupation for H-1B purposes?
Yes. USCIS consistently treats senior tax roles as specialty occupations because they normally require at least a bachelor's degree in accounting, taxation, or a closely related field. A CPA credential or an LLM in taxation strengthens the case further. The key is showing the degree requirement is standard for the position, not just preferred.
Which types of employers sponsor H-1B visas for Tax Director positions?
Big Four accounting firms, large multinational corporations with in-house tax departments, regional CPA firms, and major financial services companies are the most active sponsors for Tax Director H-1Bs. You can verify which specific employers have filed Labor Condition Applications for comparable roles using the OFLC Wage Search, or browse verified sponsoring employers directly on Migrate Mate.
What happens to my H-1B status if I move from a public accounting firm to an in-house tax role?
Changing employers requires your new employer to file a new H-1B petition before you start. You can begin working immediately once the new petition is filed and receipted, not approved, as long as it's filed before your current status expires. This portability rule under AC21 applies after you've held H-1B status for 180 days or more.
How does the prevailing wage requirement affect hiring for Tax Director roles?
Before filing your H-1B petition, your employer files an LCA certifying your offered salary meets or exceeds the prevailing wage for Tax Director in your work location. DOL sets four wage levels; senior roles typically land at Level III or IV. If the offered salary falls below the certified wage, the LCA will be rejected and the H-1B can't proceed.
Can an employer sponsor an H-1B for a remote Tax Director role?
Yes, but every location where you work must have a certified LCA posted. If you work remotely from a state different from the employer's headquarters, a separate LCA covering that worksite wage level is required. Short-term assignments under 30 days may qualify for a short-term placement exemption, but permanent remote arrangements require full LCA compliance for each location.
