Verify your degree meets specialty occupation
Tax Intern roles require a bachelor's degree in accounting, finance, or taxation to qualify as a specialty occupation under USCIS rules. A general business degree without a tax-focused concentration can trigger an RFE, so confirm your transcript reflects relevant coursework before applying.
Target firms with active LCA filing history
Search Migrate Mate to filter Tax Intern openings by employers who have filed LCAs for accounting and tax roles. Firms with consistent DOL filings are structurally set up to sponsor, unlike smaller practices that handle H-1B cases ad hoc.
Check prevailing wage before evaluating offers
Your H-1B LCA must certify a wage at or above the DOL prevailing wage for your metro area and SOC code. Use the OFLC Wage Search to look up the Level I or Level II wage for tax roles before comparing intern offers.
Confirm the employer files before OPT expires
Intern-to-full-time H-1B sponsorship depends on timing. USCIS requires the I-129 petition to be filed before your OPT or STEM OPT end date. Ask recruiting contacts about their H-1B filing calendar during the offer stage, not after you've accepted.
Review the O*NET profile for your role
Pull the O*NET occupation profile for Tax Examiners and Collectors (13-2082) to understand how USCIS evaluates specialty occupation claims for this job family. Matching your duties to the knowledge and skill requirements in that profile strengthens both your petition and any RFE response.
Ask whether the firm uses E-Verify for interns
E-Verify enrollment is required for STEM OPT employers but not universally mandated for all firms sponsoring H-1B interns. If the employer isn't E-Verify enrolled, your STEM OPT extension won't be valid there, which affects your timeline before the H-1B cap lottery.
H-1B Visa Tax Intern: Frequently Asked Questions
Can a Tax Intern position qualify for H-1B sponsorship?
Yes, if the role requires at least a bachelor's degree in accounting, taxation, or a directly related field. USCIS evaluates Tax Intern positions under the specialty occupation standard, so the job description must specify a degree requirement, not just a preference. Internships at public accounting firms and large corporate tax departments are more likely to meet this threshold than general business roles.
Which employers typically sponsor H-1B visas for Tax Intern roles?
Large public accounting firms and multinational corporations with dedicated tax departments are the most consistent H-1B sponsors for Tax Intern positions. These employers file LCAs with the DOL each year as part of their structured hiring pipelines. Migrate Mate lets you filter Tax Intern listings by employers with verified LCA filing history, so you're not guessing about sponsorship willingness.
Does a Tax Intern H-1B petition go through the cap lottery?
Most Tax Intern H-1B petitions are cap-subject and require selection in the annual lottery, which opens each March for an October 1 start date. If the employer is a university, nonprofit research organization, or government research institution, the position may be cap-exempt. Private sector accounting firms and corporations are almost always cap-subject, so timing your internship around the lottery cycle matters.
What SOC code applies to Tax Intern roles for the LCA?
Most Tax Intern LCAs are filed under SOC code 13-2082 (Tax Examiners and Collectors, and Revenue Agents) or 13-2011 (Accountants and Auditors), depending on the actual duties. The employer's HR or immigration counsel selects the code, but it directly affects the prevailing wage the LCA must certify. You can cross-reference both codes using the OFLC Wage Search to understand what wage floor applies in your target metro area.
Can I convert an H-1B Tax Intern role to a full-time position?
Yes, but the employer must file a new H-1B petition for the full-time role unless the original petition was approved for the full duration of cap-subject status. If your intern offer becomes a full-time offer after cap selection, the I-129 already on file typically covers the transition. Confirm with the employer's immigration counsel whether your petition covers post-internship employment or requires an amendment.
