Get Access To All JobsTips for Finding H-1B Visa Sponsorship as an Operations Intern
Confirm your role meets specialty occupation
Pull the O*NET profile for your specific operations title and verify it lists a bachelor's degree as the typical entry requirement. Internships framed as general business support rarely clear the specialty occupation bar at USCIS.
Target employers with active LCA filing history
Search Migrate Mate to filter operations roles by employers who have filed Labor Condition Applications for similar titles. Prior LCA filings signal an established H-1B sponsorship process, not just a stated willingness to sponsor.
Ask about cap-exempt status early in interviews
Universities, nonprofit research institutions, and government-affiliated organizations are cap-exempt, meaning they can file your H-1B petition outside the annual lottery window. An operations internship at a qualifying entity skips the April registration entirely.
Document your degree field before the offer stage
If your degree is in a related but non-obvious field, such as systems engineering or operations research, prepare a transcript and course list showing direct alignment with the internship duties before your employer files the I-129 petition.
Verify the employer is E-Verify enrolled before accepting
H-1B sponsoring employers must be enrolled in E-Verify. Confirm enrollment status directly with the recruiter before signing an offer, since USCIS requires it for cap-subject petitions and some state laws mandate it independently.
H-1B Visa Operations Intern: Frequently Asked Questions
Can an Operations Intern role qualify for H-1B sponsorship?
Yes, but only if the position requires at least a bachelor's degree in a specific field directly related to the work, such as industrial engineering, supply chain management, or business analytics. Generalist internships that accept any major typically fail USCIS's specialty occupation definition. The job description and your degree must align clearly for the petition to hold up.
How do I find operations internships at employers who actually sponsor H-1B visas?
Migrate Mate filters operations roles by employers with verified Labor Condition Application filing history, so you can see which companies have gone through the DOL process for similar titles before. Stated sponsorship willingness in a job posting is not the same as an established filing track record, and that distinction matters when you're planning around an OPT deadline.
What happens to my H-1B sponsorship if the internship converts to a full-time role?
If your employer wants to sponsor you for H-1B after the internship, they need to submit your registration during the April cap period, typically months before your OPT expires. If you're selected in the lottery, the petition can be filed for an October 1 start date. Missing the registration window means waiting another full year, so confirm the timeline with HR before your internship ends.
Does an Operations Intern role at a university qualify for a cap-exempt H-1B?
It can. Universities and affiliated nonprofit research organizations are cap-exempt under the H-1B statute, meaning they can file petitions year-round without lottery participation. The internship must be in a specialty occupation and the employer entity itself must qualify for the exemption. Confirm the specific entity filing the petition, since some university-affiliated commercial units do not qualify.
What prevailing wage level applies to an Operations Intern on H-1B?
Prevailing wage is determined by the specific occupational classification the employer uses in the Labor Condition Application, the work location, and the assigned wage level. Entry-level internship duties typically fall at Level I under DOL's four-tier wage structure. You can look up the wage for your role and city using the OFLC Wage Search tool to verify your offered compensation meets the requirement before your employer certifies the LCA.
