Verify your pharmacy degree meets USCIS standards
USCIS requires a direct-match degree for specialty occupation status. A Pharm.D. satisfies this cleanly, but a foreign pharmacy credential needs a credential evaluation confirming U.S. equivalency before your employer files the LCA.
Target hospital systems with existing LCA history
Health-system pharmacies and academic medical centers file LCAs far more regularly than independent retail outlets. Search Migrate Mate to filter pharmacy intern roles by employers with verified H-1B filing history, so you're not guessing about sponsorship intent.
Check the prevailing wage before accepting an offer
Your employer must pay at least the DOL prevailing wage for your SOC code and work location. Run your offer through the OFLC Wage Search to confirm the wage level before signing, since a below-threshold offer can delay LCA certification.
Confirm your pharmacy intern license transfers across states
H-1B specialty occupation status for pharmacy interns depends partly on active licensure. Interstate license reciprocity isn't automatic, so verify your state board requirements early. Gaps in licensure between states can stall your employer's LCA filing.
Ask the employer about cap-exempt filing options
If your internship is hosted at a teaching hospital or university-affiliated medical center, that entity may qualify as a cap-exempt employer under INA rules, letting you file outside the annual H-1B lottery window entirely.
Use your OPT period to document specialty occupation work
USCIS scrutinizes intern roles more closely than fully licensed positions. Keep detailed records of clinical duties that require Pharm.D.-level knowledge during OPT. This documentation strengthens the specialty occupation argument when your employer files Form I-129.
H-1B Visa Pharmacy Intern: Frequently Asked Questions
Does a pharmacy intern role qualify as a specialty occupation for H-1B purposes?
Yes, provided the role requires at minimum a bachelor's degree in pharmacy or a directly related field as a standard entry requirement. Most structured intern positions inside hospital systems or retail pharmacy chains document this requirement explicitly in the job description, which is what USCIS reviews when assessing specialty occupation status for the I-129 petition.
Can an employer sponsor an H-1B for an intern rather than a full-time pharmacist?
Yes, but the employer must demonstrate the intern position itself requires a specialty occupation degree, not that a future full-time role might. Paid internship programs at health systems regularly sponsor H-1Bs for intern-level roles. Part-time or unpaid arrangements are harder to support because DOL prevailing-wage requirements still apply to the certified wage level.
How do I find pharmacy intern employers who actually sponsor H-1B visas?
Browse pharmacy intern listings on Migrate Mate, which filters employers based on verified H-1B LCA filing history. Focusing on health systems, PGY residency programs, and large retail pharmacy operators gives you the best starting pool, as these employer types have established HR processes for international sponsorship and file LCAs routinely.
What happens to my H-1B status if my pharmacy intern contract ends before I finish training?
You get a 60-day grace period after your authorized employment ends to find a new sponsor, change status, or depart. If you're mid-training and the contract ends early, a new employer can file an H-1B transfer using an I-129 petition, which extends your authorization while USCIS adjudicates the new petition under portability rules.
Does a foreign pharmacy degree affect my H-1B specialty occupation eligibility?
It can, if USCIS determines your foreign credential doesn't equate to a U.S. Pharm.D. or B.S. in pharmacy. A credential evaluation from a NACES-member organization that confirms degree equivalency is typically required as part of the I-129 filing. Without it, the employer risks receiving a Request for Evidence focused on educational qualification.
