Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a Technology Intern
Verify your role meets specialty occupation
Check the O*NET profile for your intern job code to confirm the position typically requires a related bachelor's degree. USCIS denies H-1B petitions for intern roles classified as generalist or entry-level when no specific degree field is required.
Target employers with cap-exempt status
Universities, nonprofit research organizations, and government research entities are cap-exempt, letting them file H-1B petitions year-round. Technology internships at these institutions bypass the annual lottery entirely, so prioritize them if you're approaching your OPT end date.
Search H-1B filing history on Migrate Mate
Filter Technology Intern roles by employers who have filed H-1B petitions in your specific occupation code. Migrate Mate surfaces DOL Labor Condition Application data so you can see which companies have active sponsorship history before you apply.
Confirm LCA wage compliance before signing
Cross-check your offered rate against the DOL prevailing wage for your job code and location using the OFLC Wage Search. Your employer must pay at least the Level I prevailing wage for interns; underpaid offers are a common LCA certification failure.
Time your OPT cap-gap window strategically
If your OPT expires before October 1 and your H-1B is selected in the lottery, the cap-gap rule extends your work authorization automatically. Confirm your employer files Form I-129 before your OPT end date to maintain continuous status without a work gap.
Get your transcripts evaluated before interviewing
Foreign credential evaluations from a NACES-member organization confirm your degree is equivalent to a U.S. bachelor's in the relevant technical field. Have the evaluation completed before your first interview so employers can assess sponsorship eligibility without delays.
H-1B Visa Technology Intern: Frequently Asked Questions
Can a Technology Intern position qualify for H-1B sponsorship?
Yes, if the role requires a bachelor's degree or higher in a specific field such as computer science, information systems, or electrical engineering. Generic internships listed as open to any major typically fail the specialty occupation test. Review the job description carefully and confirm the degree requirement is specific before asking an employer to sponsor.
Which employers sponsor H-1B visas for technology interns?
Large tech companies, defense contractors, financial institutions with technology divisions, and university research labs are among the most active sponsors for technology intern roles. Cap-exempt employers including universities and nonprofit research organizations can file outside the lottery cycle. Use Migrate Mate to identify employers with verified H-1B LCA filing history in your specific technology occupation code.
Does an H-1B for an internship count toward the annual cap?
It depends on the employer. Internships at for-profit companies are subject to the 85,000-slot annual cap and the March lottery. Internships at qualifying universities, nonprofit research organizations, or government research entities are cap-exempt and can be filed any time of year, with no lottery requirement and faster adjudication timelines.
Can I convert an H-1B intern role to a full-time H-1B position?
If your employer sponsored your H-1B while you were interning and later promotes you to a full-time role, you typically remain under the same approved petition as long as the job duties don't change materially. A significant change in title, duties, or work location usually requires a new or amended I-129 petition filed with USCIS before the change takes effect.
What happens if I'm on OPT and my technology intern H-1B isn't selected in the lottery?
If your OPT expires before October 1, you'll need to stop working unless your employer resubmits in the next lottery cycle and you can bridge the gap through other authorized status. Some candidates pursue cap-exempt employers or explore alternative visa categories such as O-1 visa if their technical work demonstrates extraordinary ability. USCIS provides guidance on status options following an unsuccessful lottery selection.
