H-1B Visa Technical Intern Jobs
Technical Intern roles can qualify for H-1B visa sponsorship when the position requires at least a bachelor's degree in a directly related field. Employers filing an LCA must certify the role meets specialty occupation standards, so your degree-to-job alignment is what determines eligibility, not the intern title itself.

Verify your degree directly matches the role
H-1B eligibility for internships hinges on specialty occupation: USCIS requires a specific degree field, not just any bachelor's. Check the O*NET occupation profile for your target role to confirm which degree fields are listed as standard requirements.
Target employers registered with E-Verify
STEM OPT bridge strategies aside, E-Verify enrollment signals an employer's familiarity with work authorization compliance. For internship roles, that familiarity reduces the risk of an employer withdrawing sponsorship mid-process due to unfamiliarity with LCA requirements.
Search H-1B filing history on Migrate Mate
Filter by internship and technical roles on Migrate Mate to see which employers have active LCA filing history for these positions. That data tells you which companies have already cleared the DOL certification step for roles like yours.
Confirm the LCA wage tier before accepting an offer
Use the OFLC Wage Search to look up the prevailing wage for your job title, SOC code, and work location before negotiating. An offer below the DOL wage level will fail LCA certification regardless of employer intent.
Ask about cap-exempt status during interviews
Universities, nonprofits affiliated with higher education, and certain research institutions are cap-exempt, meaning no lottery applies. Technical internships at these employers can file H-1B petitions at any time of year, which changes your timeline significantly.
Time your OPT to H-1B transition carefully
If you're on OPT and your internship employer files your H-1B before April 1, cap-gap protection extends your authorization through September 30. Confirm with USCIS guidance that your OPT end date and the petition receipt date align for uninterrupted work authorization.
H-1B Visa Technical Intern: Frequently Asked Questions
Can a Technical Intern role qualify for H-1B sponsorship?
Yes, if the position genuinely requires at least a bachelor's degree in a specific field like computer science, engineering, or information systems. The intern title alone doesn't determine eligibility. USCIS evaluates whether the duties meet the specialty occupation definition, so the job description and degree requirement are what matter during adjudication.
How do I find employers who sponsor H-1B visas for technical internships?
Migrate Mate lets you search by role and filter for employers with verified LCA filing history, so you're only looking at companies that have already completed DOL certification for positions like yours. That filing history is a reliable proxy for sponsorship willingness and process familiarity, which matters especially for internship-level roles where some employers haven't filed before.
Does working as an H-1B Technical Intern count toward the annual cap?
Yes, unless your employer is a cap-exempt organization such as a university, nonprofit research institution, or government research organization. For-profit company internships count against the 65,000 regular cap or the 20,000 U.S. master's cap. This means you'd need to be selected in the annual lottery, which runs in April for an October 1 start.
What documents should I prepare to support an H-1B petition for an internship role?
You'll need academic transcripts confirming your degree field, a detailed job description from your employer showing the role requires a specific degree, and evidence connecting your coursework to the technical duties listed. If your degree is from outside the U.S., a credential evaluation from a recognized service helps establish equivalency to a U.S. bachelor's degree for USCIS review.
Can I switch from OPT to H-1B while working in a Technical Intern position?
Yes, your employer files an H-1B petition on your behalf while you're still authorized under OPT. If the petition is filed before your OPT expires and you're selected in the cap lottery, cap-gap protection under USCIS rules extends your work authorization through September 30. You can continue in the same internship role during that period without interruption.
