H-1B1 Chile Visa Data Scientist Jobs
H-1B1 Chile visa sponsorship lets Chilean data scientists work in the U.S. without entering the H-1B lottery. The 1,400-visa annual cap rarely fills, and your application goes directly to the consulate, so you can move from offer letter to approval in weeks rather than months.

Verify your degree field matches the role
H-1B1 visa requires a specialty occupation tied to a specific degree. A data science role supported by a degree in statistics, computer science, or mathematics clears that bar cleanly. A business analytics degree paired with a software engineering job title often draws scrutiny at the consulate.
Pull your O*NET occupation profile early
Consular officers assess specialty occupation using standard classification codes. Pull the O*NET profile for Data Scientist before your interview so you can cite the degree requirements listed there if the officer questions whether your role qualifies under the H-1B1 criteria.
Target employers with existing DOL LCA history
Employers who have previously filed Labor Condition Applications for data roles already understand the DOL process. Use Migrate Mate to filter for companies with verified H-1B1 Chile LCA filing history, which cuts the time spent educating HR teams from scratch.
Confirm your offer letter names a specific start date
The LCA your employer files with DOL must show an employment start date. A vague offer letter without one stalls the LCA certification step and delays your consulate appointment. Request a revised letter before your employer submits to DOL.
Check the OFLC Wage Search before salary negotiations
Your employer's LCA must certify a wage at or above the prevailing wage for your role and location. Use the OFLC Wage Search to look up the Level I through Level IV wage for your SOC code before you negotiate, so you know which offers are DOL-compliant and which aren't.
Prepare a credential evaluation before your consulate appointment
Chilean university degrees follow a different structure than U.S. four-year programs. A NACES-member evaluation translating your licenciatura or magíster into a U.S.-equivalent bachelor's or master's degree removes one of the most common reasons consular officers request additional documentation for specialty occupation cases.
Frequently Asked Questions
Does a Data Scientist role qualify as a specialty occupation under H-1B1 Chile?
Yes. Data science requires at least a bachelor's degree in a directly related field such as statistics, computer science, mathematics, or a closely related quantitative discipline. USCIS and consular officers both apply the specialty occupation standard, and the O*NET profile for Data Scientist explicitly lists a bachelor's degree as the minimum entry requirement, which supports qualification.
How does H-1B1 Chile differ from H-1B for data scientists?
H-1B1 Chile has no lottery and a 1,400-visa annual cap that historically goes unfilled, so Chilean data scientists can apply year-round without the April registration window that governs H-1B. The application goes directly to the U.S. consulate in Chile rather than through USCIS, which shortens the timeline significantly. The trade-off is that H-1B1 does not allow dual intent, meaning you cannot simultaneously pursue a green card.
How do I find employers who will sponsor an H-1B1 Chile visa for a data science position?
Use Migrate Mate to search for companies with verified H-1B1 Chile LCA filing history in data science roles. Employers who have already filed Labor Condition Applications for this visa type understand the DOL process and are far less likely to withdraw an offer once they see the sponsorship requirement. Cold outreach to companies with no prior LCA history takes significantly longer to convert.
Can my employer file the H-1B1 petition while I am already in the U.S. on a different visa status?
H-1B1 Chile is designed as a consular-processing visa, so the standard path is to apply at the U.S. consulate in Chile rather than adjusting status from inside the U.S. A change of status to H-1B1 from within the U.S. is technically possible in limited circumstances, but consular processing is the far more common and straightforward route for Chilean nationals.
What documents should I prepare before my consulate appointment for a data science H-1B1 application?
Bring your certified LCA from DOL, a signed offer letter specifying your title and start date, your educational credentials with a NACES-member evaluation if your degree is from a Chilean institution, and your DS-160 confirmation. Consular officers frequently ask data scientists to explain how their specific degree field connects to the role, so be ready to articulate that link using language consistent with your O*NET occupation profile.
