Align your credentials to U.S. specialty occupation standards
Pull the O*NET profile for Senior IT Architect to confirm the degree fields USCIS recognizes as directly related. Your Chilean university transcripts should map to a U.S. bachelor's equivalent in computer science, systems engineering, or information technology.
Target employers with active LCA filing histories
Use Migrate Mate to filter Senior IT Architect roles by employers who have filed Labor Condition Applications for this occupation code, so you're only applying to companies already set up to sponsor H-1B1 Chile candidates.
Request a certified LCA before your consulate date
Your employer must file the LCA with DOL and receive certification before you can apply at a U.S. consulate. Confirm the certified LCA is in hand at least two weeks before your scheduled appointment to avoid rescheduling.
Benchmark your offered salary against prevailing wage
Run your offered salary against the OFLC Wage Search using the correct SOC code for IT Architects before signing an offer letter. If the offer falls below the prevailing wage, the LCA won't be certifiable and your consulate application will fail.
Clarify your employer's E-Verify enrollment status early
H-1B1 visa Chile employers aren't universally required to use E-Verify, but many large tech companies are federal contractors and enrolled. Confirm your hiring manager knows E-Verify verification must happen on day one, not after your start date.
Prepare for consulate-specific technical documentation requests
U.S. consulates in Chile can request evidence that the Senior IT Architect role requires a theoretical and practical application of specialized knowledge. Bring a detailed position description, your employer's organizational chart, and evidence linking your degree to the specific technical functions of the job.
Frequently Asked Questions
Does a Senior IT Architect role qualify as a specialty occupation for H-1B1 Chile?
Yes. Senior IT Architect positions require a bachelor's degree or higher in computer science, information systems, or engineering, which satisfies the specialty occupation definition under the H-1B1 Chile rules. The key is that the specific role must require that degree in a directly related field, not just any bachelor's degree. Your employer's position description should make that connection explicit.
How does the H-1B1 Chile visa differ from H-1B for Senior IT Architect roles?
The H-1B visa1 Chile visa has no lottery, an annual cap of 1,400 that has never been reached, and is processed at the consulate rather than through USCIS. You can apply directly after your employer's LCA is certified, without waiting for an October 1 start date. The tradeoff is that H-1B1 Chile doesn't allow dual intent, so it carries stricter nonimmigrant intent requirements than H-1B.
How do I find Senior IT Architect employers who will sponsor an H-1B1 Chile visa?
Migrate Mate filters job listings by employers with verified LCA filing history for IT Architect occupation codes, so you're not cold-applying to companies unfamiliar with H-1B1 Chile sponsorship. Employers who have already filed LCAs for similar roles are significantly more likely to move quickly through the certification process for your application.
What documents does a Chilean IT Architect need for the consulate appointment?
You'll need your certified LCA, a detailed job offer letter, academic transcripts and degree certificates showing a qualifying field of study, and evidence that the role requires specialized theoretical and practical knowledge. The consulate may also request your employer's organizational chart and documentation showing the technical scope of the Senior IT Architect position.
Can I switch employers while on H-1B1 Chile status as an IT Architect?
Yes, but your new employer must file a fresh LCA with DOL and have it certified before you begin working for them. Unlike H-1B portability under AC21, there's no grace period that lets you start work while the new filing is pending. You'll also need to return to the consulate for a new visa stamp tied to the new employer.
