Verify your job qualifies as seasonal
H-2A visa is limited to temporary or seasonal positions. Data center construction tied to a defined project window qualifies, but permanent maintenance or operations roles don't. Confirm your offer letter specifies start and end dates before any filing begins.
Pull your occupation profile from O*NET
Data center construction work spans multiple O*NET codes depending on your specialty. Identifying the right one early helps your employer match the correct DOL job order and prevailing wage level, reducing the chance of a certification delay.
Search for verified sponsoring employers on Migrate Mate
Use Migrate Mate to find data center construction employers with documented H-2A filing history. Filtering by employers who have sponsored before cuts your search time and shows which companies already understand the DOL certification process.
Confirm your employer files the job order early
DOL requires H-2A job orders to be submitted at least 60 days before your start date. For data center projects with hard construction deadlines, delays in filing can push your arrival past the window when labor is actually needed.
Check the OFLC Wage Search before accepting an offer
Your employer must pay the AEWR or prevailing wage, whichever is higher. Look up the current rate for your role and state using the OFLC Wage Search so you can verify your offer meets the legal minimum before signing anything.
Understand what housing and transport your employer owes you
H-2A law requires your employer to provide free housing and transportation to and from your home country. Get written confirmation of both in your job offer. Verbal assurances aren't enforceable if disputes arise after you arrive.
Frequently Asked Questions
How do I find data center construction jobs with H-2A sponsorship?
Migrate Mate lets you search specifically for data center construction employers with H-2A filing history, so you're not cold-applying to companies that have never sponsored. Filter by job category and location to see which employers have already navigated the DOL certification process and are set up to sponsor seasonal construction workers.
What obligations does an H-2A employer have for data center construction roles?
Your employer must provide free housing for the duration of your stay, pay for your transportation from your home country and back, and guarantee wages at the AEWR or prevailing wage, whichever is higher, for the specific role and state. They must also carry workers' compensation coverage and submit a certified job order to DOL at least 60 days before your start date.
Does data center construction work qualify for the H-2A visa?
It qualifies if the position is genuinely seasonal or tied to a temporary project with a defined end date. Site preparation, trenching, cable infrastructure, and structural work connected to a specific construction project fit the H-2A requirement. Permanent on-site maintenance or full-time operations roles do not, because H-2A is restricted to work that is temporary or seasonal in nature.
Can I change data center construction employers while on an H-2A visa?
H-2A status is tied to the specific employer named in your petition. If you want to work for a different employer, that new employer must file a separate H-2A petition and obtain DOL certification before you can begin work. You can't transfer your status informally. Working for an employer not listed on your approval is a violation that can affect future visa eligibility.
