How to Get Visa Sponsorship as a Substitute Teacher
Confirm the district files E-Verify
All OPT employers must participate in E-Verify. Contact the district's HR department directly before applying to confirm enrollment. Many smaller districts are not registered, which would make them ineligible to employ you on OPT.
Track your cumulative unemployment days carefully
OPT allows a maximum of 90 unemployment days. Substitute teaching is often intermittent, so days without an active assignment count against your limit. Keep a detailed log and stay in close contact with your DSO throughout your authorization period.
Obtain state licensure or certification early
Most states require a substitute teaching permit or emergency credential. Processing takes weeks. Apply as soon as you receive your EAD card so licensure delays do not cost you employment time during your limited OPT window.
Clarify your employment structure with HR
Some districts hire substitutes as independent contractors, which is incompatible with OPT. OPT requires a standard employer-employee relationship. Confirm you will be classified as a W-2 employee before accepting any placement or signing paperwork.
Ask about H-1B sponsorship before the role begins
Substitute teaching roles rarely lead to H-1B sponsorship, but full-time permanent teaching positions sometimes do. Use your OPT period to build relationships with administrators who may convert your role into a sponsored full-time position before your status expires.

Does substitute teaching qualify as a valid OPT job?
Yes, if the work is directly related to your degree field. A substitute teaching assignment must connect to your major area of study. For example, a student with a degree in mathematics substituting in math classes meets the requirement. A completely unrelated placement does not, and working in an unauthorized role jeopardizes your OPT status.
Can I work as a substitute teacher through a staffing agency on OPT?
Yes, but only if the staffing agency is enrolled in E-Verify and classifies you as a W-2 employee. Many substitute staffing agencies use this model. The key risk is that some agencies misclassify workers as independent contractors, which is not permitted under OPT. Confirm your employment classification in writing before your first assignment.
How do intermittent substitute assignments affect my OPT unemployment limit?
Any day you are not actively employed counts toward your 90-day unemployment limit. Substitute teaching is by nature irregular, so gaps between assignments accumulate quickly. Notify your DSO of your work schedule and keep documentation of every assignment. If you approach 60 days without work, begin applying to full-time positions immediately.
