Target immigration and international law practices
Law firms handling immigration cases or cross-border transactions actively seek attorneys with relevant language skills and international legal background, making sponsorship decisions more straightforward.
Emphasize specialized legal knowledge
Highlight expertise in specific practice areas like securities law, intellectual property, or regulatory compliance that demonstrate the specialized knowledge requirement for H-1B petitions.
Consider mid-size firms over BigLaw
Mid-tier firms often have more flexibility in sponsorship decisions and may value international candidates more highly than large firms with extensive domestic talent pools.
Network through bar associations
Join American Bar Association sections and local bar associations in your practice area to build relationships with attorneys who can refer you to sponsorship-friendly firms.
Prepare for state bar admission requirements
Research state bar admission requirements early, as most states require additional coursework or exams for foreign-trained attorneys, which impacts your employment timeline and visa applications.
Document your legal writing and research skills
Prepare writing samples, research memos, and case briefs that demonstrate your ability to handle complex legal work in English, addressing common employer concerns.

Find Associate Attorney JobsFrequently Asked Questions
Do law firms sponsor H-1B visas for associate attorneys?
Yes, many law firms sponsor H-1B visas for associate attorneys, particularly those with specialized expertise or international legal backgrounds. The legal profession easily meets the specialty occupation requirement, and firms often view international attorneys as valuable for cross-border work and diverse client bases.
What degree do I need for associate attorney visa sponsorship?
You need a law degree (J.D. or foreign equivalent like LL.B.) plus bar admission in the relevant U.S. state. Foreign law degrees typically require additional coursework or passing the bar exam in your target state before you can practice as an associate attorney.
Can foreign-trained lawyers get O-1 visas as associate attorneys?
Foreign-trained attorneys with exceptional achievements like published legal scholarship, recognition from legal organizations, or significant case wins may qualify for O-1 visas. However, most associate attorney positions rely on H-1B sponsorship unless you have truly extraordinary legal accomplishments.
Do I need to pass the bar exam before getting visa sponsorship?
Most firms prefer candidates who have already passed the relevant state bar exam, but some will sponsor your visa while you complete bar admission requirements. This varies by state and firm policy, so clarify the timeline during interviews.
What's the approval rate for attorney H-1B petitions?
Legal services H-1B petitions have historically high approval rates, typically above 85%, because attorney positions clearly meet specialty occupation requirements. The main challenge is the lottery system for cap-subject positions, not the petition approval itself.
What is the prevailing wage requirement for sponsored Associate Attorney jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
