E-3 Visa Senior Litigation Counsel Jobs
Senior Litigation Counsel roles at U.S. law firms and corporate legal departments qualify as E-3 visa specialty occupations, making Australian-qualified litigators strong candidates for visa sponsorship. The E-3 has no lottery and no annual cap, so your application competes on merit, not chance. Most employers file the Labor Condition Application within days of extending an offer.

Get Access To All JobsTips for Finding E-3 Visa Sponsorship in Senior Litigation Counsel
Translate your Australian credentials for U.S. employers
U.S. hiring partners assess your qualifications against their state bar requirements, not the Australian system. Get your law degree assessed for equivalency and clarify that your LLB or JD qualifies as the bachelor's-level degree the E-3 specialty occupation standard requires.
Target in-house legal teams over law firms first
Corporate legal departments at multinationals often have established E-3 sponsorship processes and dedicated HR immigration contacts. Law firms, particularly mid-size ones, may be unfamiliar with the E-3 and require more education before committing to sponsor a Senior Litigation Counsel.
Confirm the role is litigation-specific before applying
The E-3 requires a direct nexus between your degree and the offered position. A general counsel or hybrid compliance role may not satisfy the specialty occupation requirement. Verify the job description explicitly requires litigation expertise and a law degree before pursuing sponsorship.
Ask your employer to file the LCA before your resignation
The DOL Labor Condition Application must be certified before your consulate appointment. This typically takes seven business days, but delays happen. Confirm your U.S. employer has submitted the LCA to the DOL's FLAG system before you resign from your current position in Australia.
Use Migrate Mate's E-3 filing service for your paperwork
Senior Litigation Counsel applicants often face scrutiny over specialty occupation eligibility at the consulate. Migrate Mate's E-3 filing service manages your LCA submission, DS-160, and consulate preparation end-to-end, reducing the risk of documentation errors that cause unnecessary delays.
Prepare for nonimmigrant intent questions specific to attorneys
Consular officers sometimes probe litigators about long-term U.S. career plans, given how transferable legal credentials are across jurisdictions. Have a clear, factual account of your ties to Australia and the fixed-term nature of your employment arrangement ready before your interview.
E-3 Visa Senior Litigation Counsel: Frequently Asked Questions
How do I find Senior Litigation Counsel jobs that offer E-3 visa sponsorship?
Migrate Mate is the dedicated search tool for Australian professionals looking for U.S. roles with E-3 sponsorship. It surfaces legal positions at employers who have a history of sponsoring visa holders, so you can focus on firms and corporate legal teams already set up to support the process rather than educating every prospective employer from scratch.
How much does it cost to get an E-3 visa?
Migrate Mate's E-3 filing service covers the entire process for $499, including the Labor Condition Application, visa document preparation, and consulate appointment guidance. Traditional immigration lawyers charge $2,000–$5,000+ for the same work. The E-3 has less paperwork than most work visas, so paying thousands for legal help is usually unnecessary.
Does a Senior Litigation Counsel role qualify as an E-3 specialty occupation?
Yes, provided the position requires a law degree in a relevant legal discipline as a baseline entry requirement. The E-3 specialty occupation standard is satisfied when a bachelor's-level degree in a specific field is the normal minimum for the role. Senior Litigation Counsel positions consistently meet this threshold because a law degree is a mandatory prerequisite, not a preferred qualification.
How does the E-3 compare to the H-1B for Senior Litigation Counsel applicants?
The E-3 is significantly more accessible for Australian litigators. There is no annual lottery, no cap pressure, and the application is filed directly at an Australian consulate without USCIS petition processing. The H-1B visa requires lottery selection, a USCIS petition, and often premium processing fees. For a Senior Litigation Counsel with a confirmed U.S. offer, the E-3 is a far more predictable path.
Can I change law firms or move in-house while on an E-3 as a Senior Litigation Counsel?
Yes, but you need a new LCA certified by the DOL and a new E-3 visa stamp before starting with the new employer. You cannot simply transfer the visa between employers the way an H-1B portability provision might allow. Plan for at least a two-to-four-week transition window to allow for LCA certification and, if you are outside the U.S., a new consulate appointment.
