AI ML Engineering Green Card Jobs
AI ML Engineering roles qualify for green card sponsorship under EB-2 for advanced-degree professionals and EB-3 for skilled practitioners. Employers file a PERM labor certification with DOL before petitioning USCIS, locking in your priority date and building toward permanent residency rather than a temporary visa tied to annual renewals.

Document your ML credentials before applying
PERM requires proving your qualifications match the job's minimum requirements exactly. Gather transcripts, publications, patents, and employer letters that map your ML experience to the specific SOC code your role will be filed under.
Check if your role qualifies for EB-2
AI ML Engineering positions frequently require a master's degree or its equivalent in computer science or a related field. Confirm your employer intends to file under EB-2 before accepting an offer, since EB-2 priority dates move faster for most nationalities.
Target employers with active PERM filing history
Use Migrate Mate to filter AI ML Engineering roles by employers who have actively filed PERM labor certifications, so you spend your time on companies that already sponsor green cards rather than those still figuring out the process.
Verify your employer uses E-Verify before signing
DOL requires PERM employers to post job notices and complete a good-faith recruitment process. E-Verify enrollment signals the employer has the HR infrastructure to handle sponsored hires, which reduces the risk of a PERM audit derailing your timeline.
Use OFLC Wage Search to negotiate your offer
PERM locks your offered wage at or above the DOL prevailing wage for your SOC code and location. Run the OFLC Wage Search before negotiating so you know the floor, and confirm your offer letter reflects that certified wage level.

Find AI ML Engineering JobsAI ML Engineering Green Card Sponsorship: Frequently Asked Questions
Does an AI ML Engineering role typically qualify as a specialty occupation for green card purposes?
Yes. AI ML Engineering positions routinely require at minimum a bachelor's degree in computer science, mathematics, or a closely related field, which meets USCIS's specialty occupation standard. Roles involving model architecture, training pipelines, or ML infrastructure typically satisfy EB-2 requirements when the employer mandates an advanced degree, and EB-3 when a bachelor's degree is the minimum requirement.
How does PERM green card sponsorship differ from H-1B for AI ML professionals?
H-1B is a temporary work visa with a three-year initial period, an annual lottery, and no guaranteed path to permanency. PERM green card sponsorship is a multi-step permanent residency process starting with DOL labor certification, followed by an I-140 immigrant petition, and then adjustment of status or consular processing. There is no lottery at the EB-2 or EB-3 level, though nationals of India and China face priority-date backlogs that can extend timelines significantly.
Which EB category is more common for AI ML Engineering roles, EB-2 or EB-3?
EB-2 is more common for senior and research-focused AI ML roles where the employer genuinely requires an advanced degree. EB-3 covers roles where a bachelor's degree is the stated minimum. Your employer's immigration counsel will determine the category based on the actual job duties and minimum requirements set before PERM recruitment begins, not on your personal credentials.
How can I find AI ML Engineering jobs where the employer already sponsors green cards?
Migrate Mate lets you search AI ML Engineering roles specifically filtered by employers with active PERM and I-140 filing history, so you can identify companies that have already navigated the sponsorship process. This is more reliable than asking recruiters upfront, since many hiring managers don't know their own company's PERM history until HR confirms it.
What happens to my green card case if I change employers during the PERM process?
Changing employers before your I-140 is approved restarts the PERM process entirely. Once your I-140 has been approved for at least 180 days, AC21 portability lets you move to a new employer in a same or similar occupational classification without losing your priority date. For AI ML professionals, this typically means staying within SOC codes covering software development or computer and information research science roles.
