Get Access To All JobsTips for Finding Green Card Sponsorship as a Care Assistant
Verify your credentials before applying
Long-term care employers often require state-specific CNA certification or a home health aide license before they'll initiate PERM. Confirm which credentials your target state mandates so your paperwork is complete when a sponsoring employer runs background checks.
Target employers with PERM filing history
Use Migrate Mate to filter Care Assistant and home health aide roles by employers who have previously filed PERM labor certifications, so you're applying to facilities that already understand the sponsorship process rather than pitching it from scratch.
Ask employers about prevailing wage compliance
Before accepting any offer, cross-reference the posted salary against the DOL's OFLC Wage Search for your county and job zone. A wage set below the prevailing rate will cause PERM denial, so confirm the offer meets Level I or Level II requirements upfront.
Understand the EB-3 timeline for caregiving roles
PERM recruitment, I-140 approval, and visa availability typically take two to four years for most nationals. Unlike H-1B visa, there's no lottery and no annual cap at the EB-3 category itself, making the path more predictable once your employer commits.
Clarify who pays which PERM costs
DOL rules prohibit employers from passing PERM attorney fees or recruitment advertising costs onto you. Confirm in writing before signing that your employer absorbs these expenses, since violations can jeopardize the entire labor certification.
Build a continuous employment record
USCIS scrutinizes gaps in caregiving employment when reviewing I-140 petitions for EB-3 workers. Maintain uninterrupted full-time hours with a sponsoring facility or document any gap with a written explanation supported by pay stubs or employer letters.
Green Card Care Assistant: Frequently Asked Questions
Can a Care Assistant role qualify for an EB-3 green card?
Yes. Care Assistant and home health aide positions routinely qualify under the EB-3 skilled worker or unskilled worker subcategory, depending on whether the role requires at least two years of training or experience. Your employer files a PERM labor certification with DOL to document that no qualified U.S. workers are available before sponsoring your I-140 petition.
How does EB-3 green card sponsorship differ from H-1B for a Care Assistant?
The H-1B requires a specialty occupation with at least a bachelor's degree, which most Care Assistant roles don't satisfy. EB-3 green card sponsorship through PERM is designed precisely for skilled and semi-skilled positions like caregiving. There's no lottery, no cap on the number of PERM applications, and the outcome is permanent residency rather than a temporary work authorization that must be renewed.
How do I find Care Assistant employers that sponsor green cards?
Migrate Mate lets you search specifically for Care Assistant and personal support worker roles posted by employers with PERM and I-140 filing history. Filtering by green card sponsorship history saves you from approaching facilities that have never navigated the process and may not be willing to start.
What is the PERM process and how long does it take for Care Assistants?
PERM is the DOL labor certification that requires your employer to conduct structured recruitment, advertise the position publicly, and document that no qualified U.S. workers applied. For Care Assistant roles, the recruitment phase alone takes a minimum of 60 days. Total PERM processing at DOL currently runs several months to over a year before your employer can file the I-140 petition with USCIS.
Does an employer need to be E-Verify enrolled to sponsor a green card for a Care Assistant?
E-Verify enrollment is not a universal federal requirement for PERM sponsorship, though some states mandate it for healthcare employers and government contractors. What does matter is that your employer is a legitimate legal entity in good standing, since USCIS reviews business records when adjudicating the I-140 petition following PERM approval.
