Convert your foreign license before applying
The FAA requires an Airline Transport Pilot certificate for Part 121 and most corporate operations. Start the foreign license conversion process early, PERM employers will list this as a minimum requirement, and gaps here stall labor certification before it begins.
Target Part 135 and fractional operators specifically
Charter operators under FAR Part 135 and fractional programs like NetJets-style structures have sponsored foreign pilots more consistently than Part 91 flight departments, which often lack the HR infrastructure to manage PERM filings and I-140 petitions.
Search green card sponsoring aviation employers on Migrate Mate
Use Migrate Mate to filter Corporate Pilot openings by employers with active EB-2 and EB-3 filing history, so you're applying to flight departments that have already committed to sponsoring foreign nationals rather than cold-pitching the concept.
Verify your total flight hours meet PERM job requirements
Employers filing PERM must define minimum requirements they can enforce. If the labor cert lists 3,000 total hours, you must meet that threshold at time of filing. Document your logbook carefully, because DOL audits can require verifiable hour breakdowns by aircraft category.
Ask employers about prevailing wage before accepting an offer
PERM requires your employer to pay at least the DOL prevailing wage for your position and location. Run the OFLC Wage Search yourself before negotiations so you know whether the offered salary meets the threshold USCIS will scrutinize during I-140 adjudication.
Understand EB-3 priority dates if you hold an Indian or Chinese passport
Most nationalities face minimal wait times at the EB-3 level for Corporate Pilot roles, but Indian and Chinese nationals encounter backlogs measured in years. Factor your country of birth, not citizenship, into your green card timeline expectations from day one.
Green Card Corporate Pilot: Frequently Asked Questions
Does a Corporate Pilot role qualify for EB-2 or EB-3 green card sponsorship?
Corporate Pilot positions most commonly qualify under EB-3 as skilled workers requiring more than two years of training, specifically the flight hours and FAA certifications that take years to accumulate. Some senior roles with a requirement for a bachelor's degree in aviation or aeronautical science can qualify under EB-2 for advanced-degree professionals, but EB-2 eligibility depends entirely on how the employer drafts the PERM job description.
How does green card sponsorship differ from H-1B sponsorship for pilots?
Green card sponsorship through PERM leads to permanent residency rather than temporary work authorization, and EB-3 for most nationalities carries no annual visa lottery or cap anxiety. H-1B visa sponsorship is also complicated for pilots because the FAA requires specific certificates that don't map cleanly to the H-1B specialty occupation definition. PERM is the more established and reliable sponsorship pathway for Corporate Pilot roles at most U.S. operators.
What does the PERM labor certification process require from my employer?
Your employer must conduct a DOL-supervised recruitment process to demonstrate no minimally qualified U.S. worker applied for the position. That includes specific job postings, documentation of all applicants reviewed, and a prevailing wage determination. The employer bears the filing burden and cost. Your role is to meet the published minimum requirements, which the employer must define before recruiting begins and cannot change retroactively.
How do I find Corporate Pilot employers who sponsor green cards?
Most flight departments don't advertise green card sponsorship in job postings, which makes direct research difficult. Migrate Mate filters Corporate Pilot openings by employers with documented EB-2 and EB-3 filing history, so you can focus your applications on operators who have already navigated the PERM process rather than trying to persuade a flight department to sponsor you for the first time.
Does my country of birth affect my Corporate Pilot green card timeline?
Yes, significantly. Green card priority dates are assigned by country of birth, not citizenship. Pilots born in India or China face EB-3 backlogs that can extend many years beyond the typical processing timeline. Pilots born in most other countries currently face much shorter waits at the EB-3 level. Check the monthly USCIS Visa Bulletin to understand where your priority date stands relative to the current cutoff.
