Document your specialty occupation credentials early
PERM requires proving your role demands a specific degree field, not just any bachelor's degree. Gather transcripts, credential evaluations for foreign degrees, and employer letters that tie your engineering or construction management education directly to the job duties.
Target general contractors with federal data center contracts
Federal agencies and hyperscale cloud providers build constantly and rely on contractors with established PERM filing pipelines. Firms holding active Department of Defense or GSA construction contracts are structurally more likely to sponsor green cards than smaller regional builders.
Search green card sponsoring employers on Migrate Mate
Migrate Mate filters data center construction roles by employers with active PERM and I-140 filing history, so you skip companies that have never sponsored. Use it to prioritize outreach to employers who have already run the PERM process for similar roles.
Clarify the prevailing wage tier before accepting an offer
DOL assigns one of four wage levels to your PERM position. Level I or II wages can trigger RFEs if the role actually requires advanced skills. Use OFLC Wage Search to verify the offered wage matches the complexity of your data center duties before signing.
Confirm your employer will maintain status during PERM recruitment
PERM recruitment takes 60 to 90 days of mandatory DOL advertising before filing. Ask your employer whether they'll extend your H-1B visa or maintain another valid status during that window, since your authorization cannot lapse while the labor certification is pending.
Use O*NET to align your job description with EB-2 requirements
O*NET profiles for construction management and electrical engineering roles specify typical education and skill requirements. If your duties match an O*NET profile requiring an advanced degree, that supports an EB-2 rather than EB-3 petition and can reduce your priority date wait.
Green Card Data Center Construction: Frequently Asked Questions
Do data center construction roles qualify for EB-2 or EB-3 green card sponsorship?
Both categories apply depending on the role. Project managers and engineers with master's degrees or equivalent specialized experience typically qualify under EB-2. Skilled trades workers, MEP superintendents, and site supervisors with bachelor's degrees usually fall under EB-3. Your employer's immigration attorney will assess which category fits your specific job duties and credentials before filing the PERM application.
How is PERM green card sponsorship different from H-1B for data center construction workers?
H-1B is a temporary nonimmigrant status capped at 85,000 annually with a lottery for most applicants. PERM-based green card sponsorship has no annual cap at the EB-3 level for most nationalities and leads to permanent residency. The PERM process takes longer upfront, typically 18 to 36 months from labor certification to green card approval, but it provides permanent status rather than a renewable two-year or three-year visa.
Which data center construction employers actively sponsor green cards?
Large general contractors specializing in mission-critical construction, MEP engineering firms serving hyperscale data center clients, and commissioning companies with federal contracts are the most consistent sponsors. Employers with established HR infrastructure and ongoing multi-site builds are more likely to have existing PERM processes in place. Use Migrate Mate to filter employers by verified green card filing history before applying.
What happens to my green card case if the construction project ends before my I-140 is approved?
If your employer terminates your position before the I-140 is approved, the PERM certification and any pending I-140 are typically withdrawn. Once the I-140 is approved, you gain more protection, and after 180 days in adjustment of status you can port to a similar role under AC21 portability rules. Lining up your next employer before a project closes is the safest approach.
Can a foreign-trained engineer get green card sponsorship in data center construction?
Yes, but your foreign degree must be evaluated by a credential evaluation service to confirm U.S. equivalency before USCIS will accept it. A three-year engineering degree from certain countries may be deemed equivalent to a U.S. bachelor's only when combined with relevant work experience. Get a course-by-course evaluation completed before your employer files the PERM application so there are no delays at the I-140 stage.
