Document your HVAC licensure before applying
Your PE license, state mechanical certifications, and any ASHRAE credentials directly support the specialty occupation determination in your PERM filing. Gather certified translations and official verification letters before your employer initiates the labor certification.
Target employers with active PERM filing histories
Mechanical engineering firms, large commercial contractors, and facilities management companies in sectors like healthcare and data centers regularly sponsor HVAC engineers. Use Migrate Mate to filter roles by employers with documented green card sponsorship activity.
Verify your prevailing wage tier early
Your employer must pay the DOL-certified prevailing wage before PERM is approved. Run your job title and work location through the OFLC Wage Search to see which wage level your experience and supervisory duties map to, since Level I versus Level III carries real timeline implications.
Understand the EB-2 versus EB-3 classification for your role
HVAC engineer positions requiring only a bachelor's degree typically land in EB-3. If your role requires an advanced degree or you have ten or more years of progressive experience, ask your employer to evaluate EB-2 eligibility before the I-140 is filed.
Ask about concurrent I-485 filing before accepting an offer
Nationals from countries without a significant visa backlog can often file for adjustment of status at the same time as the I-140 petition, cutting total wait time substantially. Confirm with your employer's immigration counsel whether your priority date allows concurrent filing.
Prepare a detailed job duties letter for PERM
USCIS and DOL scrutinize whether HVAC engineer duties genuinely require a specialized degree. Work with your employer to document that your role involves system design, load calculations, or code compliance work rather than general maintenance, which strengthens the specialty occupation argument.

Find Hvac Engineer JobsHvac Engineer Green Card Sponsorship: Frequently Asked Questions
Do HVAC engineer roles qualify for EB-2 or EB-3 green card sponsorship?
Most HVAC engineer positions qualify under EB-3 as professional roles requiring at least a bachelor's degree in mechanical or HVAC engineering. EB-2 is available if the position requires an advanced degree or your credentials and progressive experience meet that higher threshold. Your employer's immigration counsel determines the correct category before filing the PERM application with DOL.
How is green card sponsorship different from H-1B for HVAC engineers?
An H-1B is a temporary nonimmigrant visa with a three-year initial period and no guarantee of permanent status. A PERM-based green card, by contrast, leads directly to lawful permanent residency. There is no annual cap lottery at the EB-3 level for most countries, and the process permanently ties your authorization to the sponsoring employer until you reach adjustment of status.
How long does the PERM green card process take for HVAC engineers?
The PERM labor certification with DOL currently averages several months to over a year depending on whether an audit is triggered. After PERM approval, your employer files the I-140 immigrant petition with USCIS, which can take several additional months under standard processing. Nationals from high-demand countries may then wait for a visa number to become available before filing for adjustment of status.
Where can I find HVAC engineer jobs that offer green card sponsorship?
Migrate Mate lets you search specifically for HVAC engineer roles where employers have a documented history of employment-based green card sponsorship, so you're not guessing from generic job postings. Filtering by sponsorship type and industry, such as commercial construction or building systems, significantly narrows your search to employers already familiar with the PERM process.
Can my employer start the PERM process while I'm on a work visa?
Yes. Employers can file a PERM application with DOL on your behalf while you're working in valid status on an H-1B or another employment-based visa. This is common for HVAC engineers who want to pursue permanent residency without interrupting their current authorization. Filing PERM does not affect your nonimmigrant status, and USCIS treats the two processes independently.
