Document your degree equivalency early
PERM requires your credentials to match the job description exactly. If your bachelor's degree is from outside the U.S., get a credential evaluation from a NACES-approved agency before you start applying, not after you receive an offer.
Target employers with active PERM filings
Use the OFLC Wage Search to filter employers who have filed PERM applications for software engineering roles. A company with recent filings already understands the process and is less likely to withdraw sponsorship mid-way.
Verify your role qualifies as specialty occupation
USCIS evaluates whether a Product Software Engineer position genuinely requires a bachelor's degree in a specific field. Review the O*NET profile for your occupation to confirm the degree requirement language your employer should use in the job description.
Find green-card-sponsoring employers through Migrate Mate
Search Migrate Mate to identify Product Software Engineer roles at companies with verified green card sponsorship history. Filtering by EB-2 or EB-3 eligibility lets you focus on employers already familiar with PERM timelines and I-140 requirements.
Negotiate PERM filing timelines before accepting
Ask whether the employer starts PERM after you clear probation or immediately on hire. A six-month delay adds meaningful time to your permanent residency timeline, especially if your priority date for India or China is already backlogged.
Understand how EB-3 and EB-2 affect your wait
EB-2 requires an advanced degree or equivalent, while EB-3 covers bachelor's-level professionals. Your country of birth determines which category gives you a shorter wait, since priority date backlogs differ significantly between the two preference levels.
Green Card Product Software Engineer: Frequently Asked Questions
Does a Product Software Engineer role qualify for EB-2 or EB-3 sponsorship?
Most Product Software Engineer positions qualify for both categories depending on the degree requirement in the job description. EB-2 applies if the role requires an advanced degree or if you have a bachelor's degree plus five years of progressive experience. EB-3 applies to roles requiring a standard four-year bachelor's degree. Your employer's attorney and USCIS evaluate the job duties, not just the job title, when determining category eligibility.
How is green card sponsorship different from H-1B for this role?
H-1B visa is a temporary work visa tied to an annual lottery and capped at 85,000 slots per fiscal year. EB-2 and EB-3 green card sponsorship through PERM has no annual cap on petitions filed, and approval leads to permanent residency rather than a renewable temporary status. The tradeoff is timeline: PERM labor certification alone can take six to eighteen months before your employer even files the I-140 petition, making the overall process significantly longer than an H-1B transfer.
How long does the PERM process typically take for software engineering roles?
DOL currently processes PERM applications through analyst review, which averages several months to over a year depending on audit triggers. Software engineering roles sometimes trigger audits because they are heavily recruited positions, which can add months to the review period. After PERM certification, your employer files I-140 with USCIS, and you then apply for adjustment of status or consular processing. Your total wait for a green card also depends on your country of birth and which EB preference category you fall under.
What documentation should I prepare as a foreign product software engineer before applying?
You'll need a credential evaluation of your foreign degree from a NACES-approved evaluator, detailed employment verification letters from past employers that specify your job title, dates, and key responsibilities, and evidence that your prior work aligns with the O*NET job zone classification for software developers. If your employer is filing under EB-2 based on a combination of degree and experience, each year of progressive experience must be documented separately and cannot overlap with the experience used to satisfy the basic degree equivalency.
How do I find employers who will sponsor a green card for this role?
Use Migrate Mate to search for Product Software Engineer positions at companies with verified EB-2 and EB-3 sponsorship history. Filtering by green card sponsorship gives you a shortlist of employers who have filed PERM applications before, understand the multi-year commitment, and are less likely to withdraw sponsorship after you've accepted an offer. This is meaningfully different from applying broadly and asking about sponsorship in interviews, which often stalls at the recruiter level.
