Document your degree's specialty occupation alignment
PERM requires your role to be classified as a specialty occupation requiring a bachelor's degree in a specific field. If your degree is in computer science, software engineering, or a closely related discipline, gather transcripts and any credential evaluation now so your employer's attorney can build the labor certification file without delays.
Search verified PERM sponsors on Migrate Mate
Filter Senior Software Engineering roles by employers with documented PERM filing history using Migrate Mate. This surfaces companies that have already run the DOL labor certification process for this job title, rather than employers who are open to sponsorship in theory but have never actually filed.
Ask about prevailing wage levels before accepting an offer
DOL assigns your role a prevailing wage level (I through IV) based on duties and experience. Your offered salary must meet or exceed that level for the PERM to be certified. Cross-reference your offer against the OFLC Wage Search before signing, so you're not surprised by a wage amendment after filing starts.
Prioritize employers already enrolled in E-Verify
E-Verify enrollment is a prerequisite for STEM OPT extensions and is a reliable signal that an employer has the HR infrastructure to manage PERM and I-140 filings. Senior engineering roles at E-Verify-enrolled companies typically move through the sponsorship process with fewer administrative disruptions.
Understand EB-2 versus EB-3 before your I-140 is filed
If your role requires only a bachelor's degree, your employer will likely file an EB-3. If you hold a master's degree or can demonstrate the position requires an advanced degree, an EB-2 filing may apply. The category affects your priority date queue, so clarify which petition your employer intends to file before the I-140 is submitted to USCIS.
Target companies that run concurrent PERM cycles
Some larger tech employers run PERM filings in cohort batches, starting labor certifications for new hires shortly after onboarding. Identifying these employers during your job search, rather than negotiating sponsorship after joining, significantly reduces the gap between your start date and your priority date at DOL.
Green Card Senior Software Engineering: Frequently Asked Questions
Which green card category typically applies to Senior Software Engineering roles?
Most Senior Software Engineering positions are sponsored under EB-3 (skilled workers and professionals requiring a bachelor's degree) or EB-2 (positions requiring an advanced degree or candidates with strong credentials). If your employer can demonstrate the role genuinely requires a master's degree, an EB-2 petition through USCIS is possible. The distinction affects your priority date queue and wait times, so confirm the intended category before your employer files the I-140.
How does PERM green card sponsorship differ from H-1B for a senior software engineer?
H-1B visa is a temporary nonimmigrant status with a three-year initial period, an annual lottery cap, and no path to permanent residency on its own. PERM-based green card sponsorship is a permanent immigration pathway with no annual lottery. The EB-3 category has no per-petition cap, though country-of-birth backlogs apply to nationals of India and China. The process takes longer, typically two to four years from PERM filing to a green card, but the outcome is lawful permanent residency rather than a renewable temporary status.
What is the PERM labor certification process for a software engineering role?
PERM requires your employer to conduct a DOL-supervised recruitment campaign to demonstrate no qualified U.S. workers are available for the role. For Senior Software Engineering positions, this typically involves job postings, newspaper advertisements, and internal notices run over a defined period. DOL then reviews the recruitment results before certifying the application. Only after PERM certification can your employer file the I-140 immigrant petition with USCIS to establish your priority date.
How can I find Senior Software Engineering jobs with active green card sponsorship?
Migrate Mate lets you filter Senior Software Engineering roles by employers with documented PERM and I-140 filing history, which removes the guesswork of identifying genuinely sponsoring companies. Searching this way surfaces positions where the employer has already run the full labor certification process for this job title, not just roles where an employer has indicated general openness to sponsorship.
Can my employer start the PERM process while I'm on H-1B status?
Yes, and this is the standard path for most foreign software engineers already working in the U.S. Your employer can file PERM and the I-140 while you remain on H-1B. Once your priority date becomes current, you can file for adjustment of status on Form I-485 without needing to leave the country. Under AC21 portability rules, you may also change employers while your I-485 is pending, provided the new role is in the same or similar occupational classification.
