Document your technical degree field precisely
PERM requires the employer to define a specific minimum qualification. Make sure your degree transcript and credential evaluation explicitly name your field of study, since a generic 'bachelor's in technology' framing weakens the specialty occupation argument for EB-2 eligibility.
Target companies with dedicated solutions engineering teams
Employers who already have structured pre-sales or solutions consulting departments understand the PERM job description requirements for this role. Smaller companies hiring their first pre-sales hire often lack internal immigration infrastructure to support a multi-year green card process.
Search open green card jobs using Migrate Mate
Migrate Mate filters Technical Pre Sales roles specifically by EB-2 and EB-3 sponsorship history, saving you from applying to positions where the employer has never filed PERM. Start your search there before approaching companies cold.
Clarify the job description before PERM filing begins
The DOL locks in your job duties when the employer files the PERM application. If your actual responsibilities span both pre-sales and post-sales support, work with your employer's attorney early to frame the duties narrowly around the technical consulting function that supports the specialty occupation finding.
Check prevailing wage tier before accepting an offer
PERM requires your offered salary to meet the DOL prevailing wage for your specific job zone and location. Run your offer against the OFLC Wage Search using the correct SOC code for technical sales engineers to confirm the employer's offer qualifies before signing.
Understand EB-3 priority dates if EB-2 is unavailable
Some Technical Pre Sales roles with a bachelor's degree requirement only qualify for EB-3, not EB-2. If your country has a priority date backlog, filing as early as possible secures your place in the queue, since USCIS processes I-485 adjustment applications in priority date order.
Green Card Technical Pre Sales: Frequently Asked Questions
Does a Technical Pre Sales role qualify as a specialty occupation for green card purposes?
Yes, when the position genuinely requires a bachelor's degree or higher in a specific technical discipline such as computer science, electrical engineering, or information systems. Roles that accept any degree field or treat the degree as a preference rather than a requirement create problems during PERM and I-140 review. The employer must show the job duties tie directly to the required field of study.
How does the green card process differ from H-1B sponsorship for this role?
H-1B visa is a temporary status requiring renewal, and the annual cap lottery means many candidates never get selected. The EB-2 and EB-3 green card process through PERM has no annual cap on petitions filed, leads to permanent residency rather than a time-limited work authorization, and gives you and your employer a longer-term path. The tradeoff is timeline: PERM, I-140, and adjustment of status together typically take two to four years, depending on your country of birth and visa bulletin priority dates.
Which green card category is more common for Technical Pre Sales professionals, EB-2 or EB-3?
It depends on how the employer defines the minimum educational requirement. If the role requires a master's degree or a bachelor's degree plus progressive specialized experience, EB-2 applies. If a standard four-year bachelor's degree in a technical field is the minimum, EB-3 professional is the correct category. Many pre-sales positions qualify for either category depending on how the PERM job description is written, which is why the employer's immigration attorney should review the job duties before filing.
How do I find Technical Pre Sales employers who actively sponsor green cards?
Migrate Mate aggregates job listings specifically filtered by EB-2 and EB-3 sponsorship activity, so you can identify employers with a real track record of filing PERM applications for technical roles rather than employers who claim they will sponsor but have never done it. This matters for pre-sales roles because green card sponsorship requires a sustained employer commitment across two to four years of active employment.
Can I change jobs after my employer files the PERM but before I get my green card?
If your I-140 has been approved and is more than 180 days old, you may be able to port your priority date to a new employer's petition under AC21 portability rules, provided the new role is in the same or a similar occupational classification. Technical Pre Sales and solutions engineering roles typically fall under the same SOC category, but you should confirm the classification with an immigration attorney before changing employers to avoid losing your place in the priority date queue.
