Trial Attorney roles at law firms, government agencies, and corporate legal departments can qualify for EB-2 or EB-3 green card sponsorship through PERM labor certification. Get Access To All JobsTips for Finding Green Card Sponsorship as a Trial Attorney
Target employers with government litigation departments
Federal agencies, state attorneys general offices, and public defender organizations regularly sponsor foreign Trial Attorneys through EB-3. These employers often have established PERM workflows and aren't subject to the budget constraints that slow private-firm sponsorship decisions.
Search for green card sponsoring firms on Migrate Mate
Filter Trial Attorney roles by employers with active green card sponsorship history. Migrate Mate surfaces PERM filing data so you can prioritize firms that have completed the labor certification process for attorneys before, not just those claiming they will.
Understand how PERM recruitment windows affect your timeline
Your employer must complete DOL-mandated recruitment within 180 days before filing the PERM application. If you're already employed there, coordinate timing so the recruitment period doesn't conflict with active caseloads or trial schedules your firm needs to protect.
Check prevailing wage before negotiating your offer
Run your target job title and location through the OFLC Wage Search before accepting any offer. Your employer's PERM filing must certify they're paying at least the DOL prevailing wage level, and a below-threshold offer can derail the entire green card process.
Request concurrent I-140 and I-485 filing if your priority date is current
If the Visa Bulletin shows your country's EB-2 or EB-3 priority date is current at the time your PERM certifies, ask your employer to file I-140 and I-485 simultaneously. This lets you maintain work authorization continuously while USCIS adjudicates the green card.

Find Trial Attorney JobsTrial Attorney Green Card Sponsorship: Frequently Asked Questions
Does a Trial Attorney role qualify for EB-2 or EB-3 green card sponsorship?
Trial Attorney positions typically qualify for EB-2 because the role requires a J.D., which USCIS recognizes as a professional degree. Employers can also pursue EB-3 for candidates whose credentials or specific job duties align better with that category. The PERM labor certification process applies to both, and your employer chooses the classification when filing.
How does PERM green card sponsorship differ from H-1B sponsorship for Trial Attorneys?
H-1B is a temporary nonimmigrant status with a two-year cap cycle and lottery risk for cap-subject employers. PERM leads to permanent residency with no annual lottery. The process takes longer overall, typically two to four years including PERM certification, I-140 approval, and adjustment of status, but the outcome is a green card rather than a renewable temporary status.
Which employers commonly sponsor Trial Attorneys for green cards?
Government litigation departments at the federal and state level, large corporate legal teams, and Am Law 200 firms with established immigration programs are the most consistent sponsors. Smaller litigation boutiques do sponsor, but less frequently because PERM requires dedicated HR infrastructure. Targeting employers with prior PERM filings in the legal field narrows your search to realistic options.
How can I find Trial Attorney jobs where the employer will sponsor a green card?
Use Migrate Mate to filter Trial Attorney roles by employers with documented green card sponsorship history. Most general job boards don't surface PERM data, so you end up applying to firms that have never completed a labor certification. Starting with verified sponsorship history cuts the outreach-to-offer timeline significantly for foreign legal professionals.
Can a foreign-trained lawyer get PERM sponsorship as a Trial Attorney in the U.S.?
Yes, but you must first satisfy bar admission requirements in the state where you'll practice, since most Trial Attorney PERM filings list bar membership as a job requirement. If your foreign law degree required an LLM equivalency or state-specific bar prep, document that credential evaluation carefully before your employer submits the PERM application to DOL.
