Match your credentials to PERM requirements
PERM requires the employer to define minimum job requirements before recruiting. Get your foreign real estate, surveying, or land-use credentials evaluated by a NACES-recognized agency so your qualifications map cleanly to the posted job duties.
Target infrastructure and utility employers directly
Transportation agencies, pipeline companies, and electric utilities are among the most consistent EB-3 sponsors for Right of Way roles. Search DOL PERM disclosure data by SOC code 13-1022 to identify employers who have filed labor certifications for this occupation.
Find sponsoring employers through Migrate Mate
Filter by Right of Way Agent roles with documented green card sponsorship history on Migrate Mate. This narrows your search to employers who have already run the PERM process for this occupation, saving you the effort of qualifying employers from scratch.
Confirm the job posting meets PERM advertising rules
PERM requires your employer to run a mandatory recruitment campaign before DOL will certify the labor condition. Ask your prospective employer whether their HR team has PERM experience, since non-compliant job postings can invalidate the entire certification and reset the timeline.
Verify prevailing wage before accepting an offer
DOL sets a prevailing wage for Right of Way Agents by location and level. Use the OFLC Wage Search to check the wage tier your employer intends to file under. An offer below the prevailing wage will cause PERM denial regardless of your qualifications.
Request concurrent I-140 and I-485 filing eligibility
If your priority date is current when PERM is approved, ask your employer to file the I-140 and I-485 concurrently with USCIS. Concurrent filing lets you start accumulating work authorization while the green card is adjudicated, which significantly reduces total wait time.
Green Card Right of Way Agent: Frequently Asked Questions
Does a Right of Way Agent role qualify for EB-2 or EB-3 sponsorship?
Most Right of Way Agent positions qualify at the EB-3 level, which covers skilled workers and professionals with a bachelor's degree. Roles requiring an advanced degree in real estate, urban planning, or a related field may qualify under EB-2. The sponsoring employer defines the minimum requirements during PERM, so the classification depends on how the position is structured, not just your personal credentials.
How does green card sponsorship differ from H-1B for this role?
The EB-3 green card path has no annual lottery, so there's no risk of losing your place through random selection the way H-1B visa registrants do. PERM is more document-intensive and typically takes longer end-to-end, but the outcome is permanent residency rather than a temporary status. For nationals of countries without significant visa backlogs, the EB-3 timeline is often more predictable than the H-1B route.
Which employers typically sponsor Right of Way Agents for green cards?
Transportation departments, electric and gas utilities, pipeline operators, and land acquisition consulting firms are the most active sponsors for this occupation. These employers run recurring PERM filings because Right of Way work is tied to long-term infrastructure projects that require a stable workforce. You can identify active sponsors by reviewing DOL PERM disclosure files filtered by the SOC code for Right of Way and claims appraisers.
How can I find Right of Way Agent jobs that offer green card sponsorship?
Use Migrate Mate to search for Right of Way Agent positions where employers have a documented history of sponsoring employment-based green cards. Filtering by sponsorship history removes the guesswork of cold-applying to employers who may not be willing or equipped to run the PERM process. Prioritize employers in infrastructure-heavy sectors such as utilities, transit authorities, and energy development.
What role does the DOL prevailing wage play in my PERM application?
DOL requires your employer to pay at least the prevailing wage for your occupation and work location before it will certify the labor condition. The wage level, from Level I through Level IV, is determined by your job duties and supervisory responsibilities. If the offered salary falls below the certified prevailing wage, PERM will be denied and the process must restart. Use the OFLC Wage Search to verify the applicable wage tier before your employer files.
