Document your engineering leadership scope early
PERM requires proving your role is a specialty occupation tied to a specific degree field. Gather org charts, budget authority records, and product impact documentation now so your employer's attorney can define the position accurately before filing.
Target companies with active PERM filing history
VP Engineering roles are senior enough that many employers hesitate to start PERM without precedent. Use OFLC Wage Search to filter for companies that have already filed PERM for senior engineering titles, then prioritize those in your outreach.
Understand how EB-2 and EB-3 affect your timeline
Your country of birth determines which preference category matters more than the tier itself. Nationals from India and China face significant EB-2 backlogs, making EB-3 filing the faster route for permanent residency despite the lower classification.
Use Migrate Mate to find verified sponsoring employers
Identifying which companies will sponsor a green card for a VP Engineering hire requires more than a job search. Migrate Mate surfaces employers with documented EB-2 and EB-3 filing history for senior engineering roles, so you can focus applications where sponsorship is realistic.
Negotiate PERM initiation into your offer terms
Employers are not legally required to start PERM at hiring. During offer negotiation, ask specifically when PERM filing will begin and whether the company uses outside immigration counsel, since delays after joining can add years to your green card timeline.
Check O*NET to validate your job zone classification
USCIS uses O*NET job zone data when evaluating whether a VP Engineering role meets specialty occupation standards. Confirm your O*NET classification in advance so you can address any mismatch between your actual duties and the standard occupational definition during filing.
Green Card VP Engineering: Frequently Asked Questions
Do VP Engineering roles typically qualify for EB-2 or EB-3 green card sponsorship?
Most VP Engineering positions qualify under EB-2 because they require an advanced degree or the equivalent in engineering, computer science, or a related field. If your employer structures the role to require only a bachelor's degree, EB-3 professional is also available. USCIS evaluates the actual job requirements, not just the seniority of the title, so the job description your employer files with PERM is critical.
How does green card sponsorship differ from H-1B sponsorship for a VP Engineering role?
H-1B visa is a temporary nonimmigrant visa tied to a specific employer, subject to the annual lottery cap, and must be renewed every three years. Employment-based green card sponsorship through PERM and I-140 leads to permanent residency with no annual cap at the EB-3 level for most nationalities. The process takes longer overall, typically three to five years for non-backlogged countries, but the outcome is lawful permanent residence rather than a renewable temporary status.
What does the PERM labor certification process involve for a VP Engineering hire?
PERM requires your employer to conduct a DOL-supervised recruitment campaign demonstrating no qualified U.S. workers are available for the role. For a VP Engineering position, this typically includes job postings, internal recruitment steps, and documentation of all candidates considered. DOL then certifies the application before the employer files the I-140 immigrant petition with USCIS. The employer bears the cost and legal responsibility for PERM.
How can I find VP Engineering jobs where the employer will actually sponsor a green card?
Most job postings don't specify green card sponsorship willingness, which makes targeting the right employers difficult. Migrate Mate indexes employers with verified PERM and I-140 filing history for senior engineering roles, so you can search specifically for companies that have sponsored at the VP level before rather than asking cold during screening calls.
Can I switch employers after my PERM is filed but before I receive my green card?
Changing employers resets the PERM process unless your I-140 has been approved and you are in the final stages with an approved I-485 pending for 180 or more days. Under AC21 portability provisions, you can move to a same or similar role without losing your priority date once those conditions are met. For a VP Engineering transition, documenting that the new role is in the same occupational category is essential to preserving portability.
