Map your role to the right SOC code
AI Product Owner petitions are filed under SOC codes for software developers or computer and information systems managers. Confirm which code your employer plans to use before the LCA is submitted, since it determines your prevailing wage level and affects petition defensibility.
Verify the specialty occupation connection
USCIS scrutinizes product roles for degree specificity. Pull the O*NET profile for your target SOC code and confirm it lists a bachelor's degree in a directly related field as a typical entry requirement, then document how your actual duties align.
Search LCA filings to target active sponsors
Use Migrate Mate to filter employers by H-1B LCA filing history for AI and product management occupations. This shows you which companies have already cleared DOL certification for similar roles, cutting your search time significantly.
Check prevailing wage before negotiating salary
Run the OFLC Wage Search for your job title and work location before your offer call. Your offered salary must meet the DOL prevailing wage for the specific SOC code and geographic area, and going in informed prevents last-minute petition complications.
Flag AI tool ownership in your job description
If your role involves owning a model pipeline or making architectural decisions about AI systems, ensure the written job description captures that. Vague product language weakens the specialty occupation argument; specific technical responsibilities strengthen the I-129 petition narrative.
Time your transfer around premium processing windows
If you're changing employers mid-status, your 60-day grace period starts when your current employment ends. Premium processing reduces USCIS adjudication to 15 business days, which matters when your start date and grace period deadline are close together.
H-1B Visa AI Product Owner: Frequently Asked Questions
Does an AI Product Owner role qualify as a specialty occupation for H-1B purposes?
Yes, if the job description requires a bachelor's degree or higher in a specific technical field such as computer science, data science, or engineering. Generic product management duties alone may not meet the bar. Roles that include hands-on AI system ownership, model evaluation, or technical roadmap decisions are more defensible because USCIS looks for a direct relationship between the required degree and the job's core duties.
Which SOC code do employers typically use when filing an H-1B for an AI Product Owner?
Most employers file under either 15-1252 (Software Developers) or 11-3021 (Computer and Information Systems Managers), depending on how technical the role is. The choice affects the DOL prevailing wage level and the O*NET profile used to support specialty occupation. Ask your employer's immigration counsel which code they plan to use before the LCA is submitted, since switching later delays certification.
How do I find employers who are actively sponsoring H-1B visas for AI Product Owner roles?
Migrate Mate lets you filter job listings by verified LCA filing history, so you can identify companies that have already obtained DOL certification for AI and product management titles. This is more reliable than assuming any company that posts an AI Product Owner role will sponsor, since LCA filings confirm actual H-1B intent rather than just hiring interest.
Can an AI Product Owner role be filed as cap-exempt?
Possibly, if your employer is a qualifying institution such as a university, a nonprofit affiliated with one, or a government research organization. Most AI product roles at tech companies and startups are cap-subject, meaning you'd need to go through the annual H-1B lottery. If you're already in H-1B status and changing employers, your new petition is also cap-exempt under portability rules established by AC21.
What documentation strengthens an H-1B petition for an AI Product Owner?
A detailed job description that ties specific duties to your degree field is the foundation. Supporting documents include your academic transcripts, any credentials in machine learning or product management, and a letter from the employer explaining why the role requires a technically specialized degree. If your degree field doesn't exactly match the job title, a credentials evaluation showing equivalency can fill the gap for USCIS adjudication purposes.
