H-1B Visa Machine Learning Intern Jobs
Machine Learning Intern roles qualify as H-1B visa specialty occupations when they require a bachelor's degree in computer science, statistics, or a related field. Many research-driven employers sponsor H-1B transfers mid-internship or convert interns to full-time sponsored positions before cap season.

Verify your degree field matches the role
USCIS requires a direct relationship between your degree field and the internship duties. A statistics or data science degree supports ML intern roles more cleanly than a general business degree, which can trigger a Request for Evidence.
Check employer LCA filings before applying
Use Migrate Mate to filter ML intern postings by employers who have active Labor Condition Applications on file. Employers without prior LCA history often lack the internal HR infrastructure to sponsor in time for your start date.
Look up prevailing wage before negotiating
Run the SOC code for your specific ML role through the OFLC Wage Search before your offer call. DOL sets a wage floor by location and experience level, so knowing Level I and Level II thresholds prevents accepting an offer that can't legally support sponsorship.
Target cap-exempt employers for faster sponsorship
Universities, nonprofit research labs, and government-affiliated institutions are cap-exempt under USCIS rules. ML intern roles at these organizations can be sponsored outside the annual lottery window, which matters if you're between OPT expiration and cap selection.
Clarify sponsorship scope during the offer stage
Ask HR specifically whether sponsorship covers only the internship period or extends to a full-time H-1B after conversion. Some employers sponsor the intern status under OPT STEM extension and file the H-1B cap petition concurrently, not separately.
Use O*NET to frame your specialty occupation case
The O*NET occupation profile for Machine Learning Engineer lists the education and skill requirements USCIS reviewers reference when evaluating specialty occupation. Aligning your job duties description to O*NET language reduces RFE risk on the I-129 petition.
H-1B Visa Machine Learning Intern: Frequently Asked Questions
Can an internship qualify as a specialty occupation for H-1B sponsorship?
Yes, if the role genuinely requires a bachelor's degree or higher in a specific field like computer science or statistics. USCIS evaluates the actual duties, not the title. ML intern roles at research-driven employers typically qualify because the work requires theoretical knowledge in machine learning, not just general computer skills.
How do I find Machine Learning Intern employers who actively sponsor H-1B visas?
Migrate Mate filters ML intern postings by employers with verified H-1B Labor Condition Application history on file with DOL. This tells you which companies have gone through the sponsorship process before, which is a stronger signal than an employer simply saying they're open to sponsorship during a recruiter call.
Does my F-1 OPT status affect how and when an employer can sponsor my H-1B?
If you're on OPT or STEM OPT, your employer can file your H-1B cap-subject petition during the annual registration window for a October 1 start date. If your OPT expires before October 1, cap-gap protection under USCIS rules extends your work authorization automatically once the petition is filed and selected, as long as you maintain continuous employment.
What happens if my ML internship converts to a full-time role before H-1B cap season?
Your employer can keep you on OPT STEM extension while preparing your H-1B petition for the next cap cycle. If your degree field qualifies for STEM OPT, you can work for up to three years post-graduation without H-1B status, giving your employer time to file properly without rushing the process.
Is a master's degree in machine learning or data science required for H-1B sponsorship as an intern?
A bachelor's degree is the minimum USCIS requires for specialty occupation status. A master's degree strengthens the petition because it reinforces the direct connection between your credentials and the role, but it isn't required. What matters is that the position itself requires at least a bachelor's in a specifically related field, not just a preference for one.
