Align your degree field to the role
USCIS evaluates whether your specific degree directly relates to the data or analytics position. A computer science or statistics degree maps cleanly, but a general business degree may trigger an RFE unless your job description specifies quantitative requirements.
Check LCA filings by occupation code
Use the OFLC Wage Search to filter Labor Condition Applications by SOC code before applying. Data analysts fall under 15-2051, data scientists under 15-2041. Employers with recent certified LCAs in your target code are actively hiring for sponsored roles.
Target E-Verify enrolled employers early
STEM OPT extensions and cap-gap protections require your employer to be E-Verify enrolled. Confirm enrollment status before accepting an offer, not after, since switching employers mid-process resets your timeline and paperwork.
Search verified H-1B sponsors on Migrate Mate
Filter by data and analytics job titles on Migrate Mate to surface employers with confirmed H-1B filing history for your occupation. This cuts out companies that list roles without a track record of sponsoring the specific SOC codes you need.
Negotiate your offer against prevailing wage tiers
DOL assigns your offered salary to one of four prevailing wage levels. Level I covers entry roles; Level III and IV reflect senior and principal positions. Your LCA wage must meet the level matching your actual duties, so your offer letter and job description must align precisely.
Document project outcomes before your petition
USCIS requests for evidence in analytics cases often challenge whether the role truly requires a specialty degree. Prepare a portfolio of deliverables, model documentation, or business impact reports that demonstrate the technical complexity your degree made possible.

Find Data And Analytics JobsData And Analytics H-1B Visa: Frequently Asked Questions
Do data and analytics roles qualify as specialty occupations for H-1B?
Most do, but the qualification depends on the specific role and how the employer defines minimum requirements. Data scientist and data engineer positions routinely qualify because they require at minimum a bachelor's degree in computer science, statistics, or a closely related quantitative field. General analyst roles with looser degree requirements can draw RFEs if the job description doesn't specify a theoretical or technical body of knowledge the degree unlocks.
Which employers sponsor H-1B visas for data and analytics jobs?
Technology companies, financial services firms, consulting practices, and large healthcare systems consistently file LCAs for analytics roles each cap season. You can browse data and analytics positions filtered by H-1B sponsorship history on Migrate Mate, which surfaces employers based on verified DOL Labor Condition Application filings rather than unverified job postings.
Can my employer file H-1B for a remote data analytics role?
Yes, but the LCA must list every worksite where you'll perform services, including your home address if you're working remotely. For fully remote positions, USCIS and DOL require the employer to post a public notice at your home location and certify the prevailing wage for that area, not the company's headquarters zip code. Work location changes after filing may also require an amended petition.
What SOC codes apply to H-1B data and analytics jobs?
DOL uses Standard Occupational Classification codes to determine prevailing wage levels on LCAs. Data analysts typically fall under 15-2051, data scientists under 15-2041, and database architects under 15-1243. Your employer selects the code that matches your actual duties, and USCIS reviews whether your degree field aligns with that occupation. A mismatch between your degree and the assigned SOC code is a common RFE trigger, so verify the code your employer intends to use before your offer is finalized.
Does H-1B cap-exempt status apply to data roles at universities or nonprofits?
It can. Universities, affiliated research organizations, and qualifying nonprofit research institutions are cap-exempt employers, meaning they can file H-1B petitions outside the annual lottery at any time of year. Data scientists and analysts employed directly by these institutions, or placed at them in a research capacity, may qualify. USCIS reviews the nature of the work and the employer's qualifying status, so the role still needs to meet specialty occupation standards.
