H-1B Visa Data Analyst Intern Jobs
Data Analyst Intern roles can qualify for H-1B visa sponsorship when the position requires a bachelor's degree in statistics, computer science, or a related quantitative field. Employers filing an LCA must certify the offered wage meets the DOL prevailing wage for the SOC code, so your internship offer needs to clear that threshold before USCIS even sees the petition.

Match your degree to the SOC code
USCIS evaluates whether your specific degree field aligns with the Data Analyst role's SOC code. Pull the O*NET occupation profile for your target role and confirm your transcript lists coursework in statistics, data science, or computer science, vague degree titles create RFE risk.
Check employer LCA history before applying
Not every company that posts internships files H-1B petitions. Use Migrate Mate to filter Data Analyst Intern postings by verified LCA filing history, so you're targeting employers who have already navigated the DOL certification process for similar roles.
Confirm the internship wage clears prevailing wage
Internship offers frequently come in below the DOL prevailing wage floor for the role's SOC code and work location. Run the OFLC Wage Search before accepting an offer, if the wage doesn't meet Level 1 prevailing wage, the LCA can't be certified and H-1B filing can't proceed.
Time your OPT carefully around cap registration
If you're on F-1 OPT when H-1B cap registration opens each March, your OPT end date and any cap-gap extension window must cover your expected start date. An internship that converts to full-time after the lottery can extend your authorization through October 1 under cap-gap rules.
Get the employer's EIN verified before filing
USCIS cross-references the petitioning employer's IRS Employer Identification Number against DOL LCA records. Internship programs run through staffing intermediaries or third-party payroll providers can create EIN mismatches that delay adjudication, so confirm which legal entity will actually employ you.
Request a cap-exempt employer if lottery odds concern you
Universities, nonprofit research organizations, and government research institutions are exempt from the H-1B annual cap. Data Analyst Intern roles at these entities can be filed any time of year without lottery exposure, and the 85,000-slot cap doesn't apply to your petition.
H-1B Visa Data Analyst Intern: Frequently Asked Questions
Can a Data Analyst Intern role qualify as a specialty occupation for H-1B purposes?
Yes, if the employer requires at least a bachelor's degree in a directly related field such as statistics, computer science, mathematics, or information systems. USCIS scrutinizes internship-level positions more closely than senior roles because the degree requirement must be tied to the specific duties, not just listed as a preference. The job description needs to show that a theoretical or technical background is essential to perform the analytical work.
Do H-1B employers have to pay interns prevailing wage?
Yes. The DOL Labor Condition Application requires the employer to certify that the offered wage equals or exceeds the prevailing wage for the role's SOC code in that geographic area, regardless of whether the position is classified as an internship. There's no internship exception under H-1B rules. If the offered wage falls below the Level 1 prevailing wage, the LCA won't be certified and the H-1B petition can't be filed.
How do I find Data Analyst Intern jobs where the employer actively sponsors H-1B visas?
Migrate Mate filters job listings by verified DOL LCA filing history, so you can see which employers have filed Labor Condition Applications for data analyst roles rather than guessing based on company size or reputation. Targeting employers with an established LCA track record shortens the hiring timeline because they've already built the internal process for H-1B sponsorship.
What happens to my H-1B petition if the internship ends before October 1?
If you're on F-1 OPT and your employer filed an H-1B petition during the March registration window, cap-gap rules automatically extend your OPT work authorization through September 30 while the petition is pending. If the internship ends before that date, the cap-gap extension still protects your status, but you'll need a new employer or a change of status to maintain work authorization after October 1.
Can a staffing agency or third-party employer file an H-1B for a Data Analyst Intern placed at a client site?
Yes, but USCIS applies heightened scrutiny to third-party placement arrangements. The staffing agency must demonstrate it controls the work, sets the employee's schedule, and holds the right to terminate. The end-client's worksite location must appear on the LCA, and the prevailing wage is calculated for that location. Itinerant or unspecified placement sites are a common reason for RFEs in these arrangements.
