Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a HR Analyst
Document your degree's field alignment
USCIS scrutinizes HR Analyst petitions for degree-to-role match. Your transcript should show coursework in HR, industrial-organizational psychology, or business analytics. A general business degree without HR coursework increases RFE risk.
Search LCA filings by occupation code
HR Analyst roles file under SOC code 13-1071. Use Migrate Mate to filter employers who have filed LCAs under that code, so you're targeting companies with documented H-1B sponsorship history for your specific role.
Prioritize cap-exempt employer categories
Universities, nonprofit research institutions, and government-affiliated organizations are cap-exempt, meaning your H-1B petition bypasses the lottery entirely. HR Analyst openings at these employers let you start any time of year.
Verify the prevailing wage tier before offers
Run your job title, employer location, and SOC code through the OFLC Wage Search before accepting an offer. Your offered salary must meet at least Level I. A below-wage offer means the LCA won't certify.
Confirm the employer files I-129 directly
Some HR roles at staffing firms or PEOs involve third-party arrangements that complicate H-1B petitions. Ask whether the company filing your I-129 is your actual day-to-day employer, since USCIS requires a bona fide employer-employee relationship.
Use your 60-day grace period strategically
If your current H-1B employer terminates you, you have a 60-day grace period to secure a new sponsor. File a portability transfer under AC21 before the period ends so your status bridges to the new employer without a gap.
H-1B Visa HR Analyst: Frequently Asked Questions
Does an HR Analyst role qualify as an H-1B specialty occupation?
Yes, HR Analyst qualifies as a specialty occupation when the role requires a bachelor's degree or higher in human resources, business, organizational psychology, or a directly related field. USCIS looks at whether the degree requirement is tied to the specific duties, not just listed as a preference. Generalist HR coordinator roles with loose degree requirements carry higher RFE risk than analyst positions with quantitative or systems-focused responsibilities.
Which employers commonly sponsor H-1B visas for HR Analyst positions?
Large corporations with dedicated HR functions, HR technology companies, consulting firms, and universities are among the most consistent sponsors for this role. Cap-exempt employers, including nonprofit research organizations and higher education institutions, are worth prioritizing because they can file outside the lottery window. Use Migrate Mate to browse HR Analyst openings filtered by verified LCA filing history so you're applying to employers with an established sponsorship record.
What SOC code does USCIS use for HR Analyst roles?
HR Analysts typically fall under SOC code 13-1071, Human Resources Specialists, for LCA and prevailing wage purposes. Your employer's HR or legal team selects the code when filing the LCA with DOL. The O*NET profile for this code outlines the knowledge, skills, and degree requirements USCIS references when evaluating whether the role meets specialty occupation criteria.
Can an HR Analyst transfer H-1B sponsorship to a new employer mid-status?
Yes. Under AC21 portability, you can transfer your H-1B to a new employer once your petition has been pending or approved for at least 180 days, as long as the new role is in the same or a similar occupational classification. Your new employer files an H-1B transfer petition with USCIS, and you can start working as soon as the receipt notice is issued, before the petition is approved.
Does the HR Analyst role qualify for a STEM OPT extension before H-1B sponsorship?
It depends on your degree field. If your bachelor's or master's degree is in a STEM-designated field, such as industrial-organizational psychology, management information systems, or statistics, you may qualify for a 24-month STEM OPT extension. A standard HR or business administration degree typically does not qualify. Check your degree's CIP code against the DHS STEM Designated Degree Program list to confirm eligibility before relying on the extension as a bridge to H-1B.
