Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a Data Engineer
Frame your degree against the SOC code
Data Engineer roles map to SOC 15-1243 in DOL filings. Make sure your resume and credentials explicitly connect your degree field to data pipeline, warehousing, or ETL work so the specialty occupation determination is clear-cut.
Pull LCA records before your interview
Run the OFLC Wage Search to see what wage levels competing employers have filed for Data Engineer roles in your target metro. If an offer comes in at Level 1, you'll know to push back before the LCA is submitted.
Search H-1B sponsors on Migrate Mate
Migrate Mate filters job listings by verified H-1B filing history, so you're only seeing Data Engineer roles at employers who have actively sponsored the visa. That cuts out companies that say they're open to sponsorship but have never filed.
Clarify cap-exempt status with staffing firms
Some Data Engineer contracts route through universities or nonprofit research institutions, which are cap-exempt. Ask whether the end client or the staffing firm is the H-1B petitioner, since cap-exempt status depends entirely on who signs the petition.
Request premium processing before your OPT expires
USCIS upgrades H-1B petitions to 15-business-day processing with a premium processing fee. If your OPT end date is close to October 1, confirm your employer will file premium so an RFE doesn't leave you in a gap.
Document cloud certifications as specialty evidence
USCIS adjudicators sometimes issue RFEs on Data Engineer petitions when the degree is in a broad field like information technology. AWS, GCP, or Azure certifications tied to specific pipeline architecture can strengthen the specialty occupation argument in your petition.
H-1B Visa Data Engineer: Frequently Asked Questions
Does a Data Engineer role qualify as a specialty occupation for H-1B purposes?
Yes. Data Engineer positions typically require a bachelor's degree or higher in computer science, information systems, or a related technical field, which meets the USCIS specialty occupation standard. The role maps to SOC code 15-1243 in DOL filings. If your job description emphasizes general IT support rather than specialized data architecture, your employer may need to add specificity before USCIS accepts the petition.
What wage level should my H-1B LCA show for a Data Engineer role?
DOL assigns wage levels from 1 to 4 based on experience and complexity. Most mid-level Data Engineer roles fall at Level 2 or 3. You can verify the prevailing wage for your specific metro area and SOC code using the OFLC Wage Search before you accept an offer. A Level 1 wage on an LCA for a role with significant design responsibility can signal a problem worth raising with your employer early.
How do I find Data Engineer jobs where the employer will actually sponsor H-1B?
The most reliable approach is to target employers with documented H-1B filing history in your specific role type. Migrate Mate surfaces Data Engineer listings filtered by verified LCA filing records, so you're focused on employers who have gone through the process before rather than those who express vague willingness. Previous filings in your role category and metro area are a strong signal that HR already knows the process.
Can I transfer my H-1B to a new Data Engineer employer mid-year?
Yes. H-1B portability under AC21 lets you start work with a new employer as soon as the transfer petition is filed with USCIS, without waiting for approval, as long as your current H-1B has been approved for at least 180 days. Your new employer files a new LCA and I-129 petition. The role doesn't have to be identical, but it must remain a specialty occupation with a comparable degree requirement.
Does the type of data stack I work with affect my H-1B petition?
Indirectly, yes. USCIS evaluates whether the position genuinely requires a specialized degree, not just technical tools. Petitions for roles centered on well-defined data engineering work like pipeline architecture, data modeling, or distributed systems are typically more straightforward than broad titles covering general analytics support. Your offer letter and job duties description should reflect the specialized scope, since adjudicators have issued RFEs when duties appeared interchangeable with general IT roles.
