Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a Data Engineer Intern
Align your degree to the role
USCIS requires your degree field to directly relate to the data engineering duties. A computer science, statistics, or information systems degree strengthens your specialty occupation case. A general business degree typically won't satisfy the requirement for this role.
Verify employer LCA filing history first
Use Migrate Mate to check which companies have active Labor Condition Applications for data engineering roles before applying. Employers without LCA history for this occupation code may lack the internal process to sponsor an H-1B intern on schedule.
Target E-Verify enrolled employers early
If you're on OPT and targeting STEM extension eligibility, your employer must be enrolled in E-Verify. Confirm E-Verify status during your application screening, not after you've signed an offer, to avoid losing months of work authorization.
Check the prevailing wage tier for your city
Intern-level data engineering roles are typically classified at DOL wage Level I or II. Run your job title and work location through the OFLC Wage Search before your offer stage so you can evaluate whether the offered wage meets the certified LCA wage floor.
Confirm cap-subject status before the lottery deadline
Most private-sector intern employers are cap-subject, meaning your H-1B petition enters the annual lottery with an April 1 filing window. Ask your employer's HR team explicitly whether they are cap-exempt before February each year to plan your timeline.
Request the SOC code on your offer documentation
Data Engineer Intern roles can be filed under different Standard Occupational Classification codes, which directly affects your prevailing wage obligation and specialty occupation argument. Ask your employer which SOC code they plan to use on the LCA before the petition is filed.
H-1B Visa Data Engineer Intern: Frequently Asked Questions
Can an employer sponsor an H-1B for an internship-level data engineering role?
Yes, H-1B sponsorship is available for intern-level roles if the position genuinely requires a bachelor's degree or higher in a directly related field. USCIS evaluates the actual job duties, not the job title. A data engineer intern role that involves building pipelines, writing SQL, or working in Python-based data infrastructure typically qualifies as a specialty occupation, but the employer must document the degree requirement clearly in the Labor Condition Application and petition.
How do I find data engineer intern employers who sponsor H-1B visas?
Search Migrate Mate to filter data engineering roles by verified LCA filing history. Employers who have previously certified LCAs for data engineering positions have already established the DOL filing process, which makes them far more likely to sponsor new H-1B petitions efficiently. Targeting these employers reduces the risk of an offer falling through due to an employer's unfamiliarity with H-1B requirements.
Does a data engineer intern role qualify as a STEM OPT position?
It can, depending on the SOC code the employer assigns and whether the role falls within a STEM-designated field. Data engineering roles classified under computer and information research science or software development occupations typically qualify. You'll need to confirm the employer is enrolled in E-Verify, which is a mandatory STEM OPT requirement, and that your DSO agrees the role aligns with your degree program before requesting the extension.
What happens to my H-1B sponsorship if my internship ends before the petition is approved?
If your internship term ends before USCIS approves your H-1B petition, your authorization to work at that employer ends with it. A pending H-1B petition does not by itself extend your work authorization past your OPT or other underlying status expiration. Discuss the petition timeline with your employer before accepting an offer so both parties understand the risks if approval falls after your internship end date.
Which SOC code do employers typically use for data engineer intern H-1B petitions?
Employers most commonly file data engineer intern roles under SOC 15-1242 (Database Architects) or SOC 15-1252 (Software Developers, Quality Assurance Analysts, and Testers), depending on the specific duties. The SOC code determines the DOL prevailing wage level the employer must pay, so it directly affects your offer. Cross-reference the assigned code against your actual duties using O*NET to verify the classification is accurate before the petition is filed.
