Align your degree to the role description
USCIS scrutinizes whether your specific degree field directly relates to the analyst role. A public policy or economics degree ties cleanly to most positions, but a general business degree may trigger an RFE unless the job posting explicitly requires it.
Look up prevailing wages before negotiating
Your employer's LCA must certify a wage at or above the DOL prevailing rate for your location and occupation. Check the OFLC Wage Search using the correct SOC code for policy analysts before you discuss compensation so you know the floor.
Target employers with cap-exempt filing history
Universities, affiliated nonprofits, and government research organizations can file H-1B petitions outside the annual cap. Policy analyst roles at these institutions let you bypass the lottery entirely, which matters if you're already approaching the end of your authorized stay.
Search verified H-1B sponsors on Migrate Mate
Filter by policy analyst roles at employers with documented H-1B LCA filing history. Migrate Mate surfaces DOL Labor Condition Application data so you apply only to organizations that have already committed to sponsoring this occupation.
Clarify visa support before the final interview round
Some think tanks and advocacy organizations have sponsored H-1B workers before but lack in-house immigration counsel. Ask HR whether they use outside immigration attorneys and confirm they understand the LCA filing must precede your I-129 petition submission to USCIS.
Use O*NET to document your specialty occupation case
The O*NET profile for policy analysts lists the typical education, tasks, and knowledge domains USCIS references when evaluating specialty occupation status. Reference this profile when preparing documentation that connects your degree to the specific duties in your offer letter.
H-1B Visa Policy Analyst: Frequently Asked Questions
Does a Policy Analyst role qualify as a specialty occupation for H-1B purposes?
Yes, in most cases, provided the position requires at least a bachelor's degree in a specific field such as public policy, political science, economics, or a directly related discipline. USCIS looks at whether the degree requirement is standard across the industry for that role, not just an employer preference. Vague postings that accept any bachelor's degree can draw RFEs, so the job description wording matters.
Which types of employers sponsor H-1B visas for Policy Analyst positions?
Federal contractors, consulting firms, think tanks, universities, and large NGOs are the most consistent sponsors for policy analyst roles. Government agencies themselves generally cannot sponsor H-1B petitions directly, but contractors working on federal projects regularly do. You can find employers with verified H-1B filing history for this occupation on Migrate Mate, filtered by role and location.
What happens to my H-1B status if my policy analyst contract ends before the petition expires?
You enter a 60-day grace period from your last day of employment, during which you can transfer to a new H-1B sponsor, change status to another visa category, or prepare to depart. The grace period is triggered once per authorized validity period. Your new employer must file an H-1B transfer petition before the 60 days elapse to maintain lawful status.
Can a nonprofit think tank or advocacy organization sponsor an H-1B for a Policy Analyst?
Yes, and if the organization qualifies as a nonprofit affiliated with a university or government research institution, it may be cap-exempt, meaning it can file year-round without going through the lottery. Standard nonprofits that don't meet the cap-exempt criteria are still eligible sponsors but must participate in the annual H-1B registration process in March.
How does the H-1B prevailing wage requirement affect Policy Analyst job offers?
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your specific occupation code, experience level, and work location. Prevailing wages for policy analysts vary significantly by geography and seniority tier. You can verify the applicable rate using the OFLC Wage Search before accepting an offer to confirm your employer's proposed salary meets the legal threshold.
