H-1B Visa Data Analyst Jobs
Data Analyst roles qualify for H-1B visa sponsorship as specialty occupations requiring at least a bachelor's degree in statistics, computer science, mathematics, or a related quantitative field. Employers file a Labor Condition Application with the DOL before petitioning USCIS, and the annual cap means timing your job search around the April lottery window matters.

Frame your degree for specialty occupation
USCIS scrutinizes whether your specific degree field directly relates to data analysis work. A degree in statistics, mathematics, or computer science maps cleanly. A business or liberal arts degree requires stronger documentation linking your coursework to the role.
Target employers with active LCA filings
Use Migrate Mate to filter Data Analyst roles by employers who have filed Labor Condition Applications, so you're applying to companies already set up to sponsor H-1B petitions rather than educating hiring managers on the process from scratch.
Check prevailing wage before negotiating your offer
Your employer must pay at least the DOL prevailing wage for your job location and level. Look up the applicable wage tier using the OFLC Wage Search before you negotiate, so your offer clears the threshold and avoids a compliance issue at the LCA stage.
Confirm the SOC code your employer plans to file under
Data Analyst roles can be filed under different Standard Occupational Classification codes, each with different prevailing wage levels. Ask your employer which SOC code they intend to use, then cross-reference the O*NET occupation profile to confirm your duties align with that classification.
Register by March if you're transitioning off OPT
H-1B cap registrations open in March for an October 1 start date. If your OPT expires before October 1, you'll need a cap-gap extension to keep working legally. Confirm your OPT end date against the lottery timeline early so your employer can plan the filing accordingly.
Verify your employer's E-Verify enrollment before accepting
If your role qualifies for a STEM OPT extension and you're bridging to H-1B, your employer must be enrolled in E-Verify to authorize your STEM extension. Confirm enrollment status before accepting an offer, not after you've already transitioned.
H-1B Visa Data Analyst: Frequently Asked Questions
Does a Data Analyst role qualify as an H-1B specialty occupation?
Yes, provided the position genuinely requires at least a bachelor's degree in a directly related field such as statistics, computer science, mathematics, or information systems. Roles where any bachelor's degree is accepted regardless of field are harder to qualify. The job description and internal requirements documentation your employer provides to USCIS determine whether the role passes the specialty occupation test.
How do I find Data Analyst employers who already sponsor H-1B visas?
Migrate Mate surfaces Data Analyst roles filtered by employers with verified Labor Condition Application filing history, so you can identify companies that have already navigated the H-1B process rather than starting that conversation cold with every recruiter you contact.
Can my employer file H-1B for a Data Analyst role at a lower wage if I'm entry-level?
The DOL prevailing wage for Data Analyst roles is tiered by experience level and geographic location. Entry-level positions map to Level I or Level II wages under the applicable Standard Occupational Classification code. Your employer must pay at or above the prevailing wage for whichever level accurately reflects the actual duties and supervision in the role, verified through the OFLC Wage Search.
What happens to my H-1B status if my Data Analyst role changes significantly after approval?
A material change in duties, job location, or employment terms can require your employer to file an amended H-1B petition with USCIS before the change takes effect. Moving to a different worksite in a new metropolitan area almost always triggers an amended LCA and petition. Confirm with your employer whether a planned role change crosses the threshold for an amendment.
Is a Data Analyst job title enough to determine H-1B eligibility, or does the actual work matter?
The actual duties and degree requirements control eligibility, not the job title alone. USCIS reviews the specific tasks in the position, the degree field required, and whether those are genuinely related. A Data Analyst role that involves basic reporting with no specialized degree requirement is more vulnerable to a Request for Evidence than one requiring applied statistical modeling or machine learning methods documented in the job description.
