Document your specialty occupation case early
USCIS scrutinizes Director-level product roles because the title sounds managerial rather than specialty occupation. Gather evidence that your work requires a specific bachelor's degree field, not just general business experience, before you start interviewing.
Filter employers by LCA filing history
Use Migrate Mate to identify companies that have filed LCAs specifically for product management director titles. This filters out employers who sponsor in theory but have no track record filing at this seniority level.
Verify the prevailing wage tier before negotiating
Run the OFLC Wage Search for SOC code 15-2051 or 11-2021 at the Level III or IV wage tier in your target metro. Your offered salary must meet or exceed that figure for DOL to certify the LCA.
Time your application around the cap deadline
H-1B cap petitions must be filed between April 1 and the registration window in March. If you're negotiating an offer in Q3 or Q4, confirm whether the employer will file in the next cap cycle or pursue a cap-exempt pathway through a qualifying nonprofit or university affiliate.
Clarify whether the employer uses premium processing
Standard H-1B adjudication can run several months. For a Director role with a defined start date, ask during the offer stage whether the employer will elect premium processing, which USCIS adjudicates within 15 business days.
Check the employer's E-Verify enrollment status
STEM OPT and certain cap-exempt petitions require the employer to be enrolled in E-Verify. For a Director hire moving from OPT, confirm enrollment before accepting an offer to avoid post-acceptance complications with DOL compliance.
H-1B Visa Director, Product Management: Frequently Asked Questions
Does a Director, Product Management role qualify as an H-1B specialty occupation?
Yes, if the position requires a bachelor's degree or higher in a specific field such as computer science, engineering, or information systems. The challenge is that some employers write Director-level job descriptions broadly, which can invite an RFE. Strong petitions tie the degree requirement directly to the technical product decisions the role makes, not just general management duties.
Which types of employers most commonly sponsor H-1B visas for Director, Product Management roles?
Large enterprise software companies, fintech firms, cloud infrastructure providers, and growth-stage tech startups with established immigration programs file LCAs for this title most often. Companies with in-house immigration counsel or dedicated HR immigration teams are better positioned to handle the complexity of sponsoring a senior-level role. You can search employers with verified filing history on Migrate Mate.
How does the prevailing wage requirement apply to a Director-level product role?
DOL requires the employer to pay at least the prevailing wage for the specific occupation and geographic location listed on the LCA. Director roles typically fall at wage Level III or IV under OFLC classifications. You can verify the applicable wage floor using the OFLC Wage Search by SOC code and metro area before entering salary negotiations.
Can I stay in H-1B status if my Director role shifts from one product area to another within the same company?
A significant change in job duties, location, or employment terms may require an amended H-1B petition. If your role expands to cover a substantially different product line or you move to a new work location not covered by the original LCA, the employer must file an amendment with USCIS before the change takes effect to maintain compliance.
What happens to my H-1B status if I'm laid off from a Director, Product Management position?
You have a 60-day grace period from the date your employment ends to find a new sponsoring employer, transfer your H-1B, or take other action to maintain status. During this window you cannot work. Filing a transfer petition with a new employer before the 60 days expire allows you to begin work once USCIS receives the petition, under portability rules.
