Verify your NP credentials meet specialty occupation
H-1B approval for NPs hinges on demonstrating that a master's degree in nursing or a related clinical field is the normal minimum for the role. Pull the O*NET profile for Nurse Practitioners to document the degree requirement before your employer files.
Target cap-exempt employers first
Hospitals affiliated with a nonprofit research institution or university are cap-exempt, meaning they can file your H-1B petition any time of year without entering the lottery. Focus your search on academic medical centers and Level I trauma centers with teaching affiliations.
Search LCA filings to confirm employer sponsorship history
Use Migrate Mate to filter emergency medicine employers by verified DOL LCA filing history, so you're only applying to health systems that have actively sponsored NP roles rather than guessing from job postings.
Check prevailing wage before negotiating your offer
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your SOC code and practice location. Run the OFLC Wage Search before you receive an offer so you know the wage floor and can negotiate from an informed position.
Confirm state NP licensure covers your sponsoring facility
USCIS requires that you hold an active, unrestricted state license to practice in the state where your employer is filing. Emergency departments that operate across multiple sites may need separate LCAs for each location, which affects your petition timeline.
Align your I-129 filing with your OPT or grace period window
If you're transitioning from F-1 OPT, your employer must file the I-129 before your EAD expires. Cap-subject filings must also account for USCIS premium processing timelines if you need a faster adjudication decision to maintain continuous work authorization.

Find Emergency Medicine Nurse Practitioner JobsEmergency Medicine Nurse Practitioner H-1B Visa: Frequently Asked Questions
Does an Emergency Medicine NP role qualify as a specialty occupation for H-1B purposes?
Yes, provided the position requires at least a master's degree in nursing or a directly related clinical field as a minimum entry requirement. USCIS evaluates this on a case-by-case basis, so the job description must explicitly require the degree rather than list it as preferred. Positions that accept any bachelor's degree regardless of field are at higher risk of an RFE.
Which types of employers sponsor H-1B visas for Emergency Medicine Nurse Practitioners?
Academic medical centers, nonprofit hospital systems, and Level I and II trauma centers with university affiliations are the most active sponsors for this role. These employers are often cap-exempt, letting them file year-round. To find emergency medicine employers with verified LCA filing history for NP roles, search on Migrate Mate before applying.
Can I work at multiple emergency department locations under one H-1B petition?
Not automatically. If your employer operates emergency departments in more than one metropolitan statistical area, they generally need to file a separate LCA for each worksite. Short-term placements under 60 continuous days may qualify for a short-term placement exception, but your primary work location must be covered by a certified LCA tied to your I-129 petition.
What happens to my H-1B status if my employer loses its hospital accreditation or closes an ED site?
If your employing entity loses accreditation or closes the site listed on your petition, your H-1B authorization for that location becomes invalid. You have a 60-day grace period after an involuntary termination to find a new sponsor and have a new H-1B petition filed on your behalf. Transferring your petition to a new cap-exempt employer can be done concurrently, letting you start work on the filing receipt.
Does holding a compact nursing license satisfy the state licensure requirement for H-1B filing?
A compact license is generally accepted if your employer's state participates in the Nurse Licensure Compact and your primary state of residence grants multistate privileges. USCIS requires an active, unrestricted license valid in the state of employment at the time of filing. If your compact privileges are restricted or your home state is not a compact state, you'll need a single-state license for the petition state.
