Verify your role qualifies as specialty occupation
Pull the O*NET profile for your specific energy job title and confirm the listed education requirement is a bachelor's degree in a directly related field. A general engineering degree supporting a niche grid-systems role may need additional documentation to satisfy USCIS.
Check prevailing wage tiers before negotiating
Run your job title and work location through the OFLC Wage Search before salary talks. Energy roles in frontier markets like offshore wind or hydrogen often carry Level III or IV wages, and your offer must meet or exceed the certified LCA wage.
Target employers with active LCA filing history
Search Migrate Mate to identify energy companies that have filed LCAs for roles matching your occupation code. Employers already in the DOL system for petroleum engineers or power systems analysts move faster through the H-1B process than first-time sponsors.
Ask about cap-exempt project work early
Some energy contractors place engineers at universities, national laboratories, or DOE-affiliated research facilities. Assignments at qualifying institutions can make your petition cap-exempt, bypassing the lottery entirely. Confirm this with the employer before the registration window opens.
Align your start date with project timelines
Energy employers often tie headcount to project phases, and H-1B petitions have an October 1 standard start date. Discuss whether the role can absorb a gap between your offer date and your authorized start so the project schedule doesn't disqualify you before filing.
Document field experience that supports your degree
USCIS scrutinizes energy roles where the degree field isn't an exact match, such as a mechanical engineer in a solar thermal role. Gather performance reviews, professional licenses, and project records that establish a direct connection between your academic background and the specific position.
H-1B Visa Energy: Frequently Asked Questions
Which energy job titles commonly qualify for H-1B sponsorship?
Roles that routinely qualify include petroleum engineers, power systems engineers, renewable energy engineers, environmental engineers, and energy analysts. The key requirement is that the position demands a specific bachelor's degree or higher in a directly related technical field. Generalist titles like 'energy consultant' face higher USCIS scrutiny unless the employer can document why a specific degree is required. Use Migrate Mate to browse energy roles already tied to active LCA filings.
Does working on a federal energy contract affect my H-1B petition?
It can. If your work is performed at a federal facility or under a government contract, the worksite address on the LCA must reflect where you'll physically work, not the employer's headquarters. Your employer may also need to post an LCA notice at the federal worksite. Some projects at DOE national laboratories qualify for cap-exempt status, which eliminates lottery exposure entirely.
Can I switch energy employers after my H-1B is approved?
Yes. Under AC21 portability, you can change employers after your petition has been approved and you've been working in valid H-1B status. Your new energy employer files an H-1B transfer petition, and you can start work as soon as USCIS receives it, without waiting for approval. The new role must be in the same or a similar occupational classification as your original petition.
How does prevailing wage work for energy roles in different locations?
DOL sets prevailing wages by occupation and metropolitan area, so the certified LCA wage for a petroleum engineer in Houston differs from the same role in a rural basin. Your employer must pay at least the higher of the actual wage for similarly situated workers at that site or the DOL prevailing wage. Relocating mid-employment to a new worksite requires a new or amended LCA.
What happens to my H-1B status if my energy project ends early?
If your employer terminates you before your H-1B period ends, you enter a 60-day grace period to find a new employer, file a change of status, or depart the U.S. Your previous employer is also responsible for paying your return transportation costs. Starting a transfer petition with a new energy employer during the grace period preserves your status while the new petition is pending.
