Document your specialty occupation credentials clearly
USCIS scrutinizes business development roles because the degree-to-job connection isn't always obvious. Gather transcripts, job descriptions, and any professional certifications that tie your degree field directly to strategic partnership or revenue functions.
Use O*NET to strengthen your petition framing
O*NET classifies Business Development Managers under SOC 11-2022, which supports the specialty occupation argument. Reference the listed education requirements and typical duties when working with your employer to draft the job description for the LCA and I-129.
Target employers with cap-exempt filing history
Nonprofits, universities, and research institutions affiliated with higher education are cap-exempt, meaning your petition can be filed any time, not just during the April lottery window. Use Migrate Mate to filter Head of Business Development roles by employer type and H-1B filing history.
Verify the prevailing wage before accepting an offer
Run the role's SOC code and location through OFLC Wage Search before negotiations close. Your offered salary must meet the DOL prevailing wage for Level II or Level III, depending on your experience, and underpaying disqualifies the LCA.
Request premium processing if your start date is fixed
USCIS offers premium processing for I-129 petitions, which guarantees a 15-business-day adjudication response. If you're joining mid-fiscal-year or need status confirmed before a board-level role starts, ask your employer to elect this option upfront.
Prepare for RFEs specific to business development titles
USCIS frequently issues Requests for Evidence on BD roles, questioning whether the position truly requires a specific degree. Have your employer prepare a detailed itinerary of duties showing quantitative analysis, market modeling, or finance responsibilities that require specialized academic training.
H-1B Visa Head Of Business Development: Frequently Asked Questions
Does a Head of Business Development role qualify as a specialty occupation for H-1B purposes?
Yes, if the role requires at least a bachelor's degree in a specific field such as business administration, finance, or economics. The challenge is that USCIS sometimes questions whether a generalist business degree is sufficiently specific. A well-drafted job description that emphasizes analytical, financial, or technical duties tied to a defined degree field strengthens the petition significantly.
How do I find companies that actively sponsor H-1B visas for business development roles?
Search Migrate Mate, which surfaces Head of Business Development positions filtered by employers with verified H-1B LCA filing history. Focusing on companies that have filed LCAs for similar business development or strategy titles in prior years tells you the employer already understands the sponsorship process, which reduces friction during negotiations.
Can I transfer my H-1B to a new employer if I'm already in a Head of Business Development role?
Yes. Under H-1B portability rules, you can start working for a new employer as soon as they file a new I-129 petition, provided you're maintaining valid H-1B status and haven't fallen out of status. The new employer files a fresh LCA with DOL and an I-129 with USCIS before or on your first day.
What level of prevailing wage applies to Head of Business Development positions?
Most Head of Business Development roles map to SOC code 11-2022 (Sales Managers) or 11-1021 (General and Operations Managers) depending on duties. The correct level, typically Level III or Level IV for senior leadership roles, is determined by your years of experience and supervisory scope. Run your specific SOC code and work location through OFLC Wage Search to confirm the applicable wage floor before any offer is finalized.
What happens to my H-1B status if the business development role is eliminated or I'm laid off?
You have a 60-day grace period from the date your employment ends to find a new sponsoring employer, change to another nonimmigrant status, or depart the U.S. During this window, a new employer can file an H-1B transfer petition and you can begin working once it's received by USCIS. Acting quickly is critical since the 60 days doesn't extend regardless of circumstances.
