Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a Legal Assistant
Target corporate legal departments over small firms
Large corporations with in-house legal teams file LCAs more consistently than solo practitioners or small firms. Corporate legal departments in finance, tech, and healthcare have dedicated HR processes for H-1B filings and clearer sponsorship pipelines.
Check prevailing wage tiers before negotiating
Look up the SOC code 23-2011 on the OFLC Wage Search before salary discussions. Your offer must meet at least the Level I prevailing wage for your metro area, and some employers default to Level II. Knowing the threshold protects you in negotiations.
Search verified H-1B sponsors on Migrate Mate
Filter Legal Assistant openings by employers with confirmed LCA filing history on Migrate Mate. This eliminates firms that post roles but have never sponsored H-1B workers, saving weeks of outreach to employers who won't file.
Ask about cap-exempt employer eligibility early
Nonprofits, government research organizations, and universities that employ Legal Assistants may qualify as cap-exempt H-1B sponsors. If you're near the April lottery deadline, a cap-exempt employer lets you start without waiting for the next registration cycle.
Get the LCA certified before your start date
DOL must certify the Labor Condition Application before USCIS can adjudicate your I-129. Confirm your employer has submitted the LCA to DOL at least 10 business days before your intended start date, or your authorization will be delayed.

Find Legal Assistant JobsLegal Assistant H-1B Visa: Frequently Asked Questions
Does a Legal Assistant role qualify as a specialty occupation for H-1B purposes?
It depends on how the employer defines the position. USCIS requires that the role normally requires at least a bachelor's degree in a specific field such as paralegal studies or legal studies. If the job description accepts any bachelor's degree or substitutes experience for education, USCIS may issue an RFE questioning specialty occupation status. A well-drafted job description tied to a specific degree field strengthens the petition.
Which types of employers are most likely to sponsor H-1B visas for Legal Assistants?
Corporate legal departments at mid-to-large companies, federal contractors with compliance teams, and law firms handling immigration, intellectual property, or international transactions are the most consistent H-1B sponsors for Legal Assistant roles. Migrate Mate lets you filter openings by employers with verified LCA filing history, so you can target only those who have actually sponsored workers in this occupation.
What SOC code applies to Legal Assistant roles, and why does it matter for my H-1B?
Most Legal Assistant positions are classified under SOC code 23-2011. This code determines the prevailing wage your employer must certify on the LCA, which DOL then uses to confirm you'll be paid at or above the area wage for that occupation. If your employer misclassifies the role under a lower-wage SOC code, USCIS may reject the petition or DOL may require a wage amendment during audit.
Can my H-1B petition for a Legal Assistant role be filed cap-exempt?
Yes, if your employer qualifies as cap-exempt. Nonprofits, governmental research organizations, and institutions of higher education are exempt from the annual H-1B cap. If you're hired as a Legal Assistant at a qualifying university law clinic, nonprofit legal aid organization, or similar entity, your employer can file outside the lottery at any time of year.
What happens to my H-1B status if the law firm eliminates my Legal Assistant position?
You enter a 60-day grace period from the date of termination during which you can find a new H-1B-sponsoring employer and have a new I-129 filed on your behalf. The new employer must file before the grace period ends. Your prior employer is required by USCIS to cover the cost of your return transportation to your home country if they terminate your employment.
