Verify your credentials before applying
State licensure boards require foreign-trained mental health professionals to complete credential evaluations before you can practice. Start this process early, credential review alone can take two to four months and directly affects your LCA filing timeline.
Target Federally Qualified Health Centers
FQHCs and community mental health centers file H-1B petitions regularly for licensed counselors and social workers. They're also cap-exempt if affiliated with a nonprofit or government entity, which means no lottery and faster processing.
Check prevailing wage levels before negotiating
Use the OFLC Wage Search to look up the prevailing wage for your SOC code and work location before salary discussions. DOL requires your offer to meet at least Level I, and some employers default to the lowest level unless you negotiate upward.
Search verified H-1B sponsor data on Migrate Mate
Filter by mental health SOC codes on Migrate Mate to see which employers have active LCA filing history for roles like licensed counselor or clinical social worker. This narrows your search to employers already familiar with the H-1B process.
Confirm your role qualifies as a specialty occupation
USCIS requires the position to normally require a bachelor's degree or higher in a specific field. For mental health roles, the O*NET profile supports specialty occupation classification, but your offer letter must tie the required degree field directly to the job duties.
Understand the timeline if you're changing employers
H-1B portability lets you start with a new mental health employer once USCIS receives the transfer petition, not after approval. You have a 60-day grace period after your previous position ends to file, so time your job search accordingly.
H-1B Visa Mental Health Professional: Frequently Asked Questions
Does a mental health professional role qualify as a specialty occupation for H-1B purposes?
Yes, most licensed mental health professional roles qualify. USCIS evaluates whether the position normally requires a bachelor's degree or higher in a specific field. Roles requiring a master's in clinical social work, counseling psychology, or a related field satisfy this standard. The O*NET profile for mental health counselors and social workers supports specialty occupation classification, but your employer's offer letter must specify the required degree field.
Which employers commonly sponsor H-1B visas for mental health professionals?
Hospital systems, academic medical centers, FQHCs, and large behavioral health groups are the most active H-1B sponsors for mental health roles. FQHCs and nonprofit community health centers are often cap-exempt, meaning they can file year-round without waiting for the annual lottery. Use Migrate Mate to search employers with verified LCA filing history for mental health and social work SOC codes.
How does state licensure affect my H-1B application as a mental health professional?
State licensure is a practical prerequisite even though USCIS doesn't require it as part of the H-1B petition itself. Most employers won't extend an offer until you hold or are on a clear path to licensure in their state. Foreign-trained applicants often need a credential evaluation first, which can take several months, so starting this process before you apply significantly improves your timeline.
Can I switch mental health employers while on H-1B status?
Yes, H-1B portability allows you to start working for a new employer once USCIS receives the transfer petition, without waiting for approval. Your new employer must file the H-1B transfer petition, and you have a 60-day grace period after your previous position ends to make the switch. The new role must still qualify as a specialty occupation.
What is the prevailing wage requirement for mental health professional H-1B positions?
DOL requires your employer to pay at least the prevailing wage for your occupation, job level, and work location as certified on the LCA. Prevailing wages for mental health counselors and clinical social workers vary significantly by state and metropolitan area. Use the OFLC Wage Search to look up the applicable wage level for your SOC code and location before accepting an offer.
