Document your degree's direct relevance
USCIS scrutinizes sales roles heavily because 'any degree' arguments fail specialty occupation standards. Map your business, marketing, or finance degree to the technical product knowledge the role requires. Your offer letter and employer's support letter need to make this connection explicit.
Target SaaS and fintech employers specifically
Enterprise software and fintech companies sponsor H-1B Mid Market AE roles far more consistently than traditional industries. Search Migrate Mate to filter for employers with active H-1B LCA filing history in sales occupations before you apply.
Request an H-1B transfer, not a new cap slot
If you're already on an approved H-1B, a cap-exempt transfer lets you start the new AE role as soon as USCIS receives the petition. You don't need to wait for October 1 or re-enter the lottery.
Verify the prevailing wage tier before negotiating
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your metro area and experience level. Use the OFLC Wage Search to check Level 2 versus Level 3 wages for Sales Representatives, Wholesale and Manufacturing occupations before you accept an offer.
Confirm the employer files under the right SOC code
Mid Market AE roles are sometimes filed under SOC 41-4011 or 41-3099 depending on whether you're selling technical products. The SOC code determines your prevailing wage floor, so ask your employer's attorney which code they plan to use before the LCA is submitted to DOL.
Use your 60-day grace period strategically
If you're laid off or resign, you have 60 days to secure a new H-1B transfer petition. Prioritize employers who can file within two to three weeks of an offer so the petition is in before your grace period closes.
H-1B Visa Mid Market Account Executive: Frequently Asked Questions
Does a Mid Market Account Executive role qualify as an H-1B specialty occupation?
It can, but USCIS requires the employer to demonstrate the position normally requires a bachelor's degree in a specific field, not just any degree. Roles at SaaS, fintech, or enterprise software companies that require business, marketing, or a technical degree tied to the product being sold tend to qualify. Generic sales roles with loose degree requirements are more likely to draw a Request for Evidence.
Which employers typically sponsor H-1B visas for Mid Market AE roles?
SaaS companies, fintech platforms, and enterprise software vendors are the most consistent sponsors because their sales roles often require specialized product knowledge tied to a degree field. You can find employers with verified H-1B LCA filing history in sales occupations on Migrate Mate, which surfaces DOL Labor Condition Application data so you know which companies have actually filed before.
Can I switch Mid Market AE jobs while on H-1B without losing my status?
Yes, through an H-1B transfer. Your new employer files a new I-129 petition with USCIS, and under AC21 portability you can start working as soon as the petition is received, not when it's approved. Your previous employer's H-1B cap count carries over, so you don't re-enter the lottery. The 60-day grace period applies if you've already left your prior employer.
How does quota attainment or variable pay affect my H-1B wage compliance?
Your employer's LCA must guarantee you at least the DOL prevailing wage regardless of quota performance. Commission and variable pay can supplement your base, but they can't replace it. If your base salary drops below the certified wage level at any point, your employer is out of compliance with the LCA. Confirm your base salary alone meets the prevailing wage before signing your offer.
What SOC code do employers use when filing H-1B petitions for Mid Market AE roles?
Employers typically file under SOC 41-4011 (Sales Representatives, Wholesale and Manufacturing, Technical and Scientific Products) for roles selling software or technical products, or SOC 41-3099 for broader sales roles. The code matters because it determines the prevailing wage floor your employer must certify in the LCA. Ask which SOC code the attorney plans to use and verify the corresponding wage via the OFLC Wage Search.
